"Scrolls" Lawsuit Goes To Court
The original debate started when developer Mojang decided to make the working title of their new CCG-like game "Scrolls", which prompted software publisher Bethesda Softworks to respond, citing potential confusion between Mojang's Scrolls and their own Elder Scrolls franchise.
Some time into the proceedings, Notch offered to settle the dispute with a friendly game of Quake 3, a challenge which was not answered. The proposed solution was intended to ease any potential PR incidents, and provide an amicable solution to the dispute. The challenge went unanswered, and legal proceedings continued unabated.

Notch wasn't trying to copyright any sort of word, Bethesda was pressing charges- they were the ones trying to 'copyright it'. Oh, and this is old news.
Notch won the case.
Second of all, they really aren't affected by this. You could search for the fifth game by searching with the word "Skyrim", not "Scrolls", so they probably wouldn't be affected that much.

"I feel the need to clarify a couple of things:
We realized we should apply for the trademark "Minecraft" to protect our brand. When doing so, we also sent in an application for "Scrolls". When Bethesda contacted us, we offered both to change the name to "Scrolls: " and to give up the trademark.
They refused on both counts.
Whatever reason they have for suing us, it’s not a fear of using having a trademark on the word "Scrolls", as we’ve offered to give that up."
Cover their own arses my @$$. Most people here have a right to draw the conclusion they have, this is simply a matter of two companies attacking each other, over virtual rights to a fallacious idea that you can own the word Scrolls.
And FYI to the article writer at Kotaku, when you apply for a Trademark you pretty much want to size up the article to EVERY facet of the word, why would you not want to own the rights to a potential commercial on tv for your game? and how is it that Zenimax even has the capacity to loose their copyright over Elder Scrolls?
IMHO
the two have different titles, One, Mojang should apply strictly for a copyright specifically one word titles for their game Scrolls, and then any sub title thereafter for Scrolls 2 and the like, then Bethesda should refile for a Copyright over the term Elder, Scrolls, and any combination of the two in any title, BUT not if the title ONLY contains the word scrolls, or is lacking Elder in the title.

Yeah, Bethesda, the huge game devloper with millions in sales is jealous of Notch. They are suing because it will cause confusion, nothing more. There is no jealousy, Mojang does not "deserve" to win.
Well put, Bethesda is one of my favorite companies when it comes to video gaming but this is kind of ridiculous.
I don't see why it would even be a violation using only the word, "Scrolls."
That's somewhat ignorant, in my opinion.
That's like taking a word out of the dictionary and keeping it to yourself, if anyone else says it, you arrest them.
I don't think Bethesda will really get anything out of this, Mojang probably will get that extra boost in noticability.
