I think what we really need is some sort of community police to give the big offenders a giant smack.
Sort of like the Tribunal in League. Or whatever it is. But a playerbase, with authority, to enforce a fair compensation standard.

Actually they do. They wrote it in the eula when Minecraft was made. They specifically said you may not sell any things related to ingame minecraft for real life money which means servers are illegal. They will sue people if they do not follow it from now on.

un-innovative servers are the ones that will be hurt. This is how the world works. If a company is unable to be better than the other companies it goes out of business. Therefore, companies strive to offer better content and the MineCraft world has a whole gets better.
More servers isn't always better. Few people who are actually good at development and programming can make high profit servers. Minecraft lets you make servers. If you want to host it on your home PC for you and some friends, SO BE IT. GO DO THAT. IT'S FREE! But don't go purchasing a $50 a month dedicated host that can support 500 people at one time and hope to rely on donations alone. That isn't how the real world works.
To those of you saying "If I make a mod I'm not allowed to sell it". You are allowed to sell content that you have made. If YOU wrote a bukkit plugin you are allowed to sell it. It doesn't matter if it relies on Mojang's code or not. Minecraft relies on Microsoft's or Apple's code. With out their OS Minecraft wouldn't be able to run! But Mojang can still sell their game with out being sued by Microsoft or Apple you can sell your code with out being sued by Mojang... That's how it works. Say you write a plugin that displays very nice particle effects over bow shots. You can sell that to players in game.
If some one else writes a plugin to do something, YOU ARE NOT allowed to sell that with out THEIR permission.
If you want to charge people to play on your server, that is perfectly fine. It is pretty much saying "If you want to use my computers resources, and connect to my machine over the internet, you're going to have to pay. Mojang does not own your internet when you host a server.
@Hypbling: Not the original Notch EULA, some of this stuff is Jeb's doing.
@Kabis:How many servers have a successful paywall, out of the total number of servers? Look at WoW v. the free-ish games that are on the same model. The free ones are gaining subscriber base. WoW is losing. Granted, Blizzard alienated people with Pandaria, but people will buy stuff more easily in game than they will buy a subscription. Also, you've insulted every small server out there. Bad. Very bad.
Donator perks are a necessary evil, if they're evil at all. I find it rather stupid to suggest that every server that needs an incentive for player donations is boring. For that matter, I don't see why Mojang has to weigh in on this-If players would start pushing on server owners to be better at pricing, then we wouldn't HAVE this problem. -

Sure, there are the hoarders that don't share, but most of the donators I've known spread their wealth. In general, everybody does, for that matter. I can't vouch for the factions/PvP servers, since I don't paly them myself, but I'm willing to bet that within the factions, people do share.Posted in: News

In other news, as we look at the EULA, it seems that they take contrary positions, at least from my reading.
The one major rule is that you must not distribute anything we‘ve made. By “distribute anything we‘ve made” what we mean is “give copies of the game away, make commercial use of, try to make money from, or let other people get access to our game and its parts in a way that is unfair or unreasonable”.
I parsed that as (give copies of the game away, make commercial use of, try to make money from, or let other people get access to our game and its parts) in a way that is unfair or unreasonable. I'm probably not doing it the way a certain person that started this debate is, either.
However, based on my reading, one key point stands out: UNFAIR OR UNREASONABLE. It's not unfair to give someone a small perk for giving a server money. It's unreasonable for anything to cost $10,000, yes, but MOST PERKS fall in these lines.
Thing is, then they add a bullet point list, for "clarification", that confuses things.
So the one major rule is that (unless we specifically agree it – such as in brand and asset usage guidelines) you must not:
- give copies of our Game to anyone else;
- make commercial use of anything we‘ve made;
- try to make money from anything we‘ve made; or
- let other people get access to anything we‘ve made in a way that is unfair or unreasonable
Q: Are servers trying to make money, i.e. charge ridiculous prices for items and perks that are clearly meant to make profit?
A: Most of these servers are simply attempting to recognize those who have supported them.
It's almost like saying that a charity can't acknowledge the donators it gets. Frankly, if I found out that was to be stopped, it might impact my donation, despite the fact that the effect was unchanged.
Now, the problem here, is the sharks that have the ridiculous purchases.
I think there ought to be, as Jetra suggested, a team of volunteers that go and look for overpriced BS around the servers, and then, report that to a central database, which is linked both to Mojang, AND THE COMMUNITY AT LARGE (MCForums, PMC, etc.). The sites would then be able to add warnings to servers suspected of being money pits, or extortionate. For instance, the servers where you HAVE to buy something to use certain normal items that are integral parts of Minecraftian life. That means the items CANNOT be earned by playing, not that there is an option to buy them immediately and a reasonable way to get them without having to pay. For instance, a server where there's a month wait for lava buckets and fire, or you can buy it for $4.99, as a hypothetical.
Title tags are most likely reasonable unless they're exorbitantly expensive or don't stack. (Expiring tags, I personally don't like, but the rest of the world has varying opinions on that.)
THAT, would be reasonable.
What I heard Erik saying was NOT reasonable. Granted, it was his opinion, but his opinion, he should know, has much weight and thus if there's no official opinion, he shouldn't be throwing his personal opinion out there. -

The benefit from this is that it will be easier for Mojang to support custom blocks and items in the future. It will also allow Mojang to mix and match block artwork resolutions, and make sure that you get graphics for blocks that your current texture pack isn't updated for.

The Godmodder has MIND CONTROL POWERS OF MIND CONTROLLING that Do Exactly What They Say On The Tin, and zap the brains of instant summons to his side. At which point they get a buff. I mean, seriously. Instant summoning anything is bad.

I timetravel to the past and join the Creative server, and proceed to amass weapons, armors, and the items used in the past attacks coming from the Creative Server Door. I then, on the Creative Server, check if everything on Main is installed...

A package comes through the Creative door, which I am already in the exact position to grab. The Godmodder is unable to interfere because I was moving backwards in time whilst grabbing the package. Of course, it probably contains almost nothing of real value.. However, it at the very least contains all the explosives I could possibly fit inside...
I blast more mobs with zilly, once again causing them to defend the cake.
