How this feature should work is first, in %appdata%\.minecraft(The game directory), there is a capes folder where you can put in cape templates just like the skins and in options\Skin Customizations, the "capes" get removed and gets replaced with a new "Cape Options" where there is a cape library where there are the capes you put in the capes folder and you can activate it by selecting it. It will be visible to all players even in servers and work fine just like the normal minecon capes.
Online skins way
In the profile tab on the minecraft website, there will be a new section called capes and you can activate it just the way the skins get applied.
This would be like spitting in the faces of all their fans who went minecon. And minecon is not cheap. The value and novelty of capes would become nonexistent, because everyone and their mother would have one.

capes are meant to be exclusive for OptiFine donaters (which is kinda bending the EULA IIRC)

It's not actually breaking or bending the EULA. In short, the EULA is restricting the stuff you get from donating to a server or service so it's not a 'pay2win' type. OptiFine capes are merely aesthetic and provide no advantage to gameplay whatsoever, therefore it's allowed.
