From my understanding, the EULA only states that I cannot sell Capes, which I don't even want to do. I just want to give specific people (people who have helped in developing and testing the mod) capes. Is that fine to do?

That said, Optifine has disregarded this rule for years (this article from 2014 is the first to mention the special status of capes), even technically selling them (through "donations") and no action has been taken, and there are numerous other mods that give you capes (I've seen people say that they are allowed since you can only get them if you use a mod but Mojang is the one who decides this).
