Yes, the original code was from TBPM. However, in that code, he licenses it under the GPL, which includes (right there in the code) the following text:
This program is free software: you can redistribute it and/or modify
it under the terms of the GNU General Public License as published by
the Free Software Foundation, either version 3 of the License, or
(at your option) any later version.
TBPM chose to release it as free software. (think: Linux) Therefore, anyone who wishes to can copy it, modify it, or make it sing opera, if they so desire; the only proviso is that, if they change it, they need to add a comment to that effect so that the original author isn't blamed for any bugs their changes introduce.
Any code whose author licenses it under the GPL (as in this case) is free. There are two uses of "free" in English, commonly described as free as in free speech, and free as in free beer. To distinguish them, they can be referred to as "libre" and "gratis", in that order. Free software -- that is, software licensed under the GPL, as in the case of this mod -- is libre. The GPL doesn't allow for "libre-but" ... it's libre, or it isnt. It's GPL'd, or it isn't. And TBPM chose, as I said, to make this mod libre. It's right there in the code. So neither he nor anyone else can try to place any restrictions on it, like "do not distribute" or "link to my stuff" or anything else.
The GPL is not necessarily the best software license for everyone and everything. I'm not going to address whether or not that was the case here, or whether TBPM should have chosen a different one. But that is what he chose, and therefore, the mod is free -- libre -- and anyone who wishes to can distribute it.
In short, by distributing this mod, Squirrelface48 is only doing what TBPM explicitly said he's allowed to do.

I don't even think he modified the mod, he just stole it from TBPM and said it was his... I'm honestly not trying to put him down, but he shouldn't do something like that.
