Look, if you are like me, and don't have money to dump into servers like Factions, you should read this.
Hi, I'm CB, and i'm noticing that so many servers (Especially Factions servers) are violating the server End User License Agreement (EULA)
I feel that this is pretty much against the law, so I would like to put a stop to it. By the way, the EULA is here: >EULA<
Servers are offering stuff like ranks and kits to people how pay money or "Donate" here's some stuff from the EULA:
YOU MAY:
ask for donations (as opposed to direct charges) IF you do not offer the individual donor something in exchange that only he or she can use. You may offer server wide rewards if donation goals are achieved though.
sell cosmetic items, except for "Capes", IF the item sold does not give a user an unfair gameplay advantage over anyone else on the server - i.e there can be no "pay to win".
sell positive effects or enhancements (other than "Capes") IF everyone on the server is positively affected in exactly the same way.
provide in-game advertising opportunities, sponsorships, or product placement for 3rd parties IF they don't degrade or interfere with gameplay or give a user an unfair gameplay advantage over anyone else on the server.
use in-game currencies IF (i) they are "soft currencies" i.e. a currency earned or expended only through gameplay that has no real world value and that cannot be cashed out, used or transferred across free or paid servers, or converted into "credits"; and (ii) you don't give the impression that it comes from or is associated with Mojang.
So this is a major problem. And i'm sick of it.

I agree with you that servers are out of control with the perks they offer for donations and I wish something could be done about it. Reporting, in my experience, doesn't do anything. I've reported several servers and nothing ever happened to them. Some of the largest servers blatantly offer pay to win and nothing ever happens to stop it. Mojang just doesn't seem to care about the problem.
Servers need donations to keep alive, so they cant go 100% free, however i dont agree on the pay to win donations. Donations can be handled much better then pay to win, but whenever some one, including myself, tries to make a good server thats not pay to win, the community disregards it and does nothing to help. I have started an indiegogo project, and currently i have raised a whole 10$ and noone even bothered to reply on the topic, the same people that complain dont do anything to help, Its sad but true.
If you want this to change you should support the non pay to win servers more then pay to win ones, help the good servers rise and cherish

Your thread was locked because blacklist threads aren't allowed. And I've looked through the comments of people saying that they will flag a server, and it's generally for really stupid reasons.

I completely agree! I even made a post complaining about how this website is allowing pay2win servers to be in the server section, and they just said that they are not going to enforce it. Seems like they only care about making money off of greedy servers and ads that crash people's computers. I kind of wish that we, as a community, stand up against these servers and websites that support them.

If it's allowed, then every server would do it. Hypixel, one of the top 2 servers right now used to be a P2W servers before the EULA stuff happened. If rules like that aren't stated, what server wouldn't want to sell crazy powerful ranks that make them more money?

No, the admin clearly said "If a server is violating the Mojang EULA you can report them via this form:" and then the link. All that told me or anyone else reading the thread was that as long as Mojang is fine with letting those servers roam free, the minecraftforum is too. There was no such thing stated which you said.

Dude, just don't start.... But seriously it's better not to interfere and let the people that are already in it take care of it. Ugh my god...
We're all already in it. We play a game that is being ruined by server owners that want to turn the whole multiplayer community p2w. Who else is going to stop them besides the players? If all the players join together to fight this stuff, then it'll end. If we just "ignore it", every other server will want to become p2w. Which will effectively ruin the multiplayer part of the game.

Yes. How players join a server is up to you. Single entrance fees or subscriptions are both allowed.
How often am I allowed to charge players to access my server?
You can charge players as regularly as you like. You can even charge for timed access if you think it’s the best way to monetise your server.
What counts as a server? Are proxies one big server, or lots of smaller ones?
A server is something a user connects to with their client. The user is on a different server when they leave one and manually join another (in the multiplayer screen). Virtual servers and proxies make no difference; to the client it's the same server.
Can I charge access to a specific part of my server, such as a minigame or world?
No, you cannot charge for any part of a server. Only the access. Once on a server, all players must have the same gameplay privileges. You may make a different server which features “premium” areas, and charge for access to that server instead, but the benefits cannot carry between servers.
So can I charge for my minigames or mods?
Yes, so long as all players on your server have access to the features.
Can I offer a limited trial period for all users?
Yes. So long as both trial and paying users have access to the same gameplay features during the trial, we're cool with it.
Can I give paying users priority access to my server?
Yes, but you cannot restrict gameplay elements to specific users.
Does the EULA still apply for access to user-created mods?
Yes. It doesn't make a difference who made the mods, or how they were implemented onto your server. All mods require Minecraft to run. You are not allowed to charge for Minecraft features which affect gameplay.
What do you mean by “hard currency” compared to “soft currency”?
Hard currency is real money or anything that can be converted into real money, including Bitcoins. Soft currency is available in-game only, and has no real-world value. The restrictions in the EULA only apply to hard currency; you may unlock things in-game with soft currency.
Can I sell “kits” for hard currency if I provide a balanced alternative for non-paying users?
If the “kits” contain gameplay-affecting features they are not allowed. Gameplay balance is not relevant to the EULA. If the items included in the kit are purely cosmetic, you can charge real money/hard currency.
My server features a currency that you can earn through gameplay, but which can also be bought for hard currency. Is that OK?
Soft currencies that are earned in-game are fine, but you cannot sell in-game currency for hard currency. Hybrid/dual currency systems are not allowed.
Can I sell boosters, which provide faster gold gain, XP, or other in-game resources for hard currency?
No - boosters, item generators, and all other features that affect gameplay are not allowed.
So how do I make real money from selling cosmetic items?
You can sell cosmetic items for hard currency directly or allow players to fund an “account” specific to your server. It’s up to the host of the server to decide how this works. Remember that capes are the exception to this rule - you are not allowed to give them away or sell them.
Can I sell ranks on my server?
Yes. Ranks are allowed so long as any perks gained are cosmetic. Coloured names, prefixes, special hats etc. are fine.
Can users purchase something that affects the entire server, such as a temporary XP boost?
Yes, but everyone who can access the server must be able to use the feature, regardless of whether they purchased it or not.
Can I award all players with a gameplay feature if I reach a donation goal within a time period?
Yes, so long as all players receive the benefit regardless of who donated then it’s OK.

opps sry, blame that to my developer, I think they would not just allow pay2win because this can get players advantage over another player, and in this case, mojang/microsoft can have the right to sue/close the server.
After all microsoft have too much problems (such as developing new OS, managing xbox, donating to charity, updating firewall, fixing bugs, etc...)

Yeah, I added the banner to my signature because I HATE pay2win servers that sell Protection 50 diamond armor and Sharpness 50 diamond swords, which some of them do.
Also, I made a thread complaining about how the Minecraft Forums and Mojang are allowing these huge pay2win servers to stay on here, and yet, they give me a reply stating that they aren't going to enforce it in the server list. Then the thread got locked, preventing me from giving any counter statements. This just proves that the Minecraft Forums and Mojang don't care about these pay2win servers as long as they receive some sort of profit from these servers.
