The issue with your brother being banned has nothing to do with the EULA, it has to do with whatever happened between him and the people running Hypixel.
By the way, where did you hear that Mojang made an exception for Hypixel?
Everyone that is supporting Mojang right now is basically hoping for a not pay to win environment. Thing is if these new rules are enforced, servers will be going down. The players right now don't understand that the servers need the extra donation money to keep the server up as well as provide motivation. The players are basically supporting bring down all servers and stop playing at all. There would not be a pay to win environment, yet no environment at all.
I see a LOT of hate n' flame getting thrown around here, but here's my opinion: This will be difficult to enforce, contoversial because of servers needing money, and a whole lot of other stuff, but I still agree with it, because SCREW PAY TO WIN, IF YOU WANT IT IN MINECRAFT, THEN GO DIEINAFIRE. *cough* *hack* Ahem, seriously though, PTW, or more precisely it's lack, is one of the main reasons I like Minecraft, and I have seen no way to have a PTW game/server that is as fun for non-PTW-ers as for those who pay, it's not fair, it's not fun, and I give any company/person who supports it a big thumbs down. Besides, even though this ruleset will likely not be universally followed, just the fact that Mojang has issued this makes me like them, as a company, even more.

How much do the players enjoy the communities if they have to get goodies in return for "donations." That's kind of counter to the idea of what a donation is. If I give $1000.00 to the United Way, I don't expect them to send me special branded luggage in return.

Honestly the play to win servers are only PvP servers. If your on a survival server with no pvp theres honestly no winning to be done except for surviving.

I doubt Leagues of Legends or any other popular game would survive purely on donations either with no perks.

This is what it boils down to, in the end. Can you afford it before you accept donations? If not, remember, this is a business once money is involved. If you can, fill your boots. Just remember, good business practices will get you a lot further than determination and skill alone.
If you have that much of an issue with affording a big server, then you make payment for entry mandatory if the donations aren't coming in. If the server is that compelling, you won't need to have an item for real money store. Personally I get the feeling that some (but not all) of the people upset are trying to make a living just running a Minecraft server and are upset that their profits are going to get cut into because they are doing something that is at best unfair and at worst a violation of the EULA. I don't buy that items need to be sold for a server to survive, I was once a regular on a server that got by with just donations only and had a server population of well over 100 people. I guess my suggestion for people who just stick to the idea that this is going to kill Minecraft should go code a Minecraft clone and distribute it how they please. Mojang is well within their right to do this and personally I feel that this probably should've been enforced a long while ago.
Minetest, minetest is the game you are looking for. Its an open source (c++ i believe) clone of minecraft. Is it good? Well, ummm. Is it bad. No. currently it's pretty right now, but its open source (LGPL 2.1 ), so, i believe, when done right, you can make money off it, but you have to follow a strict system of linking your payed software to the free software that doesn't break the programe when not used and some other stuff. It's basicly a softer, more money friendly, version of GPLv3. Honesty, i don't really like the game, i like minecraft, but people are acting like minecraft is opensource and it's their right to make money off it. And then they about having to use minecraft, when they don't, use minetest to get money and leave us alone. PS. Follow the LGPL 2.1 licence or you will also be slammed by people.

They own it.

ask yourself how many good servers would be out there, if everyone had to pay all of it out of their own pockets? and would Minecraft even be remotely as popular without the community creating new game modes, plugins and mods? I highly doubt it.

Even if you assume that all server owners have finished educations with well established jobs. Having 10.000$ or more, to throw into making a great server possible. Extremely unlikely!

Sorry, xD wasn't targeting PvP servers I was just trying to point out there are more then just 1 type of servers out there the EULA affects.

I mean, this all makes sense and Mojang is more than in the right to do this, but several small servers might die down. The advertising could compensate though.

Mojang has already stated that there is another way to make money from your server besides donation or Pay to Access, and its been here for awhile.. Minecraft videos. Sure, there is a split with the hosting company (YouTube most likely) but every drop helps. All you need is a style that will set you apart and a reason for people to watch. Its basically advertising for your server that pays you.
The only way this will succeed, is if mojang recodes minecraft with a master-server. This would mean that if your account gets flagged for abusing these rules, they will suspend your ability from hosting a minecraft server on your account. This also means in order to run a server on any machine you need to login to your account.
So basically it will be just like minecraft client.
1. Login, to host server.
2. Check if account is flagged for violations.
3. If not violation, host server.
4. Profit.
ELSE
3. Account flagged for violations.
4. Server disabled for online play, only LAN players can join.
5. YOU LOSE, GOOD DAY SIR.
That is the only way mojang can control servers, which i doubt their team will program. So 100,000 servers will continue to operate and abuse the EULA, which means absolutely crap. I don't see how this will be beneficial to anyone.
Not only do I highly doubt they would ever waste their time programming such a type of server, but I also am really disappointed in reading this type of suggestion. I don't understand why the solution to any problem such as this is usually resulting in everyone becoming the victim. Action should only be taken against those responsible in breaking rules.
