If server owners can't raise the funds in a way that doesn't end up with someone being scammed , making a pay to win situation or having parents complaining about there children stealing credit cards (or dealing with it if it does happen). However , I do agree that running a server should be able to be a job.
So, if a server can raise funds (disregarding the EULA for just this statement.) by making legitimate sales (as I said, disregard EULA) which do not end in P2W, and support is set up to help those users that have troubles with their transactions and a option to get a refund and users are 100% aware of what they are purchasing, so no scamming is involved would you say this is OK? Because that is exactly what my server had setup prior to this EULA explosion. There are servers out there abusing the system. But why should all servers be punished? I think that maybe limits should be set, not a complete ban. For eg:
* The most expensive rank can only be a certain % of the total server cost. To avoid servers making 200% profit of a single rank or something ridiculous. (This can be proven through invoices from your hosting company and can be easily proven if you are abusing.)
* This one would be very hard to prove, but ranks cannot be P2W. I guess it can be fairly obvious if a point system is set up on a minigame. It's farily obvious when non-playing players have, let's say 0 - 200 points and paying players have 2000+, but as I said, this one would be hard to prove.

Yeah Mojang decided to make your server not startable until you set do "eula=true" thus, agreeing to it.
It looks like your using some crappy shared hosting? In which case, your host would've put that there because they were probably getting lots of support tickets like "HALP MII SRVRER IZ NAWT STERTING EP" because they hadn't agreed to the EULA in that file.
Well. A "Hobby" server would almost have to be a small private server. Any public server would almost immediately end up with business aspects due to the number of things you need to consider (Paying for the server , advertising to get people on, what sort of server you need (specs) , what server software you need , how you will get the money to pay for the website, etc).

You actually have to accept an EULA.
Some message saying your automatically agreeing to the EULA if you do something like play the game or visit the website is not enough to set a legally binding EULA.
However - Those T&C you have to agree to when you buy your account, well yeah that means you have agreed to the EULA, because they can update them to say "If you agree to the T&C your automatically agreeing to the Mojang EULA which can be found at *EULAlink*."
However, in expansion to that, they might be able to legally say in the EULA, that it is abandoned as soon as you close the game, until you open it back up again, it is active.
But again, if you didn't buy the account, agree to the TOS or anything then that above doesn't apply.
While I agree with everyone on the P2W part of everything, I also strongly disagree with every other part of the new Eula. I completely agree with everyone saying that most big servers will be going down. Sure, if you're server is completely reliant on donations, you're probably not running it right morally, but you can't do anything about that. Hosting a massive server like Hypixel of Mineplex costs money. And a LOT at that. 2-5k players on at once from what I see That's expensive.. I saw a post above of someone basically saying the same thing as me, that it's not a matter of whether or not you have the time to run big servers, it's weather or not the bill exceeds what you're making. I think that any server should be allowed to charge for anything, as they are. If people are pissed at p2w games, don't play them. If parents are mad about their kids spending all their money, then ground them or something, be a parent. It's your fault your kid knows your info, not mojang's.
Basically what I'm saying is that if you can't afford higher tier ranks/kits/ect, that's your problem. In real life, you can pay people and stuff for higher priorities. If you wanna donate and get nothing back, do it. If you wanna pay a server to get something special, then you should be allowed to. If a server lets you buy admin commands like ban and such, then that's just not a good server. If a server is charging $200 for one diamond sword, and you buy it, that's your problem. Servers shouldn't need to be limited in any way. Minecraft is a sandbox. So let it be what it wants to be. If multiplayer wants to be filled with donor ranks and such, let it. If people don't like that, play single player. Simple.
So yeah, that's my piece of the puzzle in. Agree or disagree with me, I don't care.
Donations should not be used to fund a server and only to upgrade it. I use my donations for server upgrades (CPU, SSD, few GB RAM,..) but the most expensive was Xenforo (damn you xenforo)

I agree to an extent, this works in the case of my server as i own the collocated hardware, however for my US and EU servers, its different.
I'm renting my EU and US hardware, because I don't live there, if i want to upgrade my RAM or something, It's not a one off payment, your paying more per month, which means by your logic, you are not necessarily upgrading your server, but finding a more expensive server and you should be funding that, which is not really fair.
So it depends, I'd agree if you own the hardware and if you get extra RAM or a new SSD for it, It's a one off payment right?
If your renting the hardware, It's not exactly a one off payment.

Well , Mojang can just ignore Operation Blackout , since they agreed to the EULA when they bought the game . they agreed to it so they must follow it and not complain since they no longer can scam kids , they see Mojang as their dog , but no . This is illegal since the game existed .

If there is no "Agree to this" when MC starts then the EULA posted on their web site doesn't apply.
You CANNOT force people to accept terms which are not displayed for them to see.
The EULA only applies to the original purchaser, IE, the person who installed it on their system.
If a friend uses a piece of software the EULA doesn't apply to the friend. This is how FedEX is setup.

According to the webpage, I guess the servers who participate in "Operation Blackout" won't turn the servers back on if Mojang doesn't revert.
