Why do servers need to exploit Minecraft to make money? Why do server owners not fund their own servers? Why do server owners make a server assuming most of the costs should be covered by "donations" and not their own money? Why is it wrong for Mojang to exercise their legal right in the name of fairness and to stop complaints?
What about teleport command's? I play on a smallish semi vanilla server and you have to buy rank for teleport command's due to it being abused. If every noob that join's the server has teleport commands me and other players will be spammed with teleport request's!

I think this is a fair deal Mojang is making. It is her game after all, so it is understandable that she doesn't want people make money with (pieces of) her game. With this EULA, the differences between donations and fees are becoming clear again, and servers that want to make money, can still do that on a clear, fair way. A server can, so I understand, even make a special paid server with extra cool features, so she can still give something extra for those who want to support the server with money, without annoying the other players.
Some will maybe say that this is quite a change after those years, but this kind of things happen all the time, everywhere. Compagnies as of governments do always react on what is happening over time and sometimes it can take a while before a proper answer is given. It is sometimes quite annoying yes, but you can't do anything about that and we are still just human.
There's a difference between running a server as a business and maintaining a state of homeostasis through donations. Mojang loses no money from servers doing this; in fact, it probably generates positive feelings for the game and sells more copies of the game. As for servers that make money/sell things for unreasonable prices, I agree, they should be condemned. But the server I play on uses donations purely to keep the server running; I fail to see why Mojang should get their proverbial panties in a knot because of things like that.
It's because there are certain servers that sell perks like instant endgame items and it ruins the game for both the donator because it takes the sport out of minecraft and the non donators because they can't compete. It's not about mojang's money, it's about the player experience.

I've been on servers that would have admins and owners giving special attention to donators, such as tping people in pvp bases, or reseting the homes of non-donator factions. Also Donors will often get impossible items like swords with sharpness 6 or prot 5 armor, stuff that nondonors could only dream of.
"sells more copies of the game" I don't see how it would, unless minecraft servers advertise on other websites and on billboards about minecraft. And if they did do that I doubt that they would advertise minecraft as a whole rather than their particular server.

Nope. Rank can't be dependent on money. You'd have to implement a rank system that was earned through non-monetary means if teleportation was dependent on rank. Such as making people higher rank as they showed maturity or had longevity on the server.

teleport is a gameplay mechanic, so it would fall under the EULA's restrictions.
While your worry is founded, the likely solution would be to remove the teleport command. As this post says, servers will have to work out how to compensate for the changes.
If you have to use teleport to play, then maybe you are doing it wrong?

An Example would be: Super Smash Mobs, Hero's and Premium have access to specific mobs.
Now, with some of these rules such as the ability to give players cosmetic changes and the ability to charge for some minigames and mods (look in the Q'n'A). Now, because of the ability to charge for some minigames and the cosmetic changes for people who (whatever the word is for people who give money for something, not Donators), the way I see it, servers could make it so people who pay, don't have to pay AS MUCH as people who don't pay.
Another example would be: Hero's pay XXX's for Mob1, where as non-payers pay XXXX's for Mob1. The way I see it, that is allowed, but they can't say that Hero's can pay XX for Mob2, but non-payers CAN'T buy Mob2, even if they have alot of X's.
Could someone be kind enough to explain that to me and let me know if that is allowed?
Also: Voting? is this affected by the EULA at all? Can I still vote for a server and get the things they say from the Voting?

My bet is the servers that can't maintain more than 20% capacity (ie. "oh look a 200 slot server... with 4 users on") will die out or choose to be free at a huge loss, whereas the servers that can maintain more users will charge a very reasonable rate and grow enormously.

As for the "self-created need" these server's needs are, for all practical purposes, Minecraft's needs. Without servers, Minecraft wouldn't have sold however many millions of copies it has. I understand that it is Mojang's right implement their Eula, however I fail to see why they are doing so. It seems completely unreasonable, and they'll lose a good number of long-time players due to the fact that good, solid servers are being shut down.
In short, beyond increased realms sales and a dubious increase in reputation, what does Mojang stand to gain?

That's the way it should be. The money a server gets through donations should go directly to paying server fees and paying people who actually work to maintain them. That is the same way non-profit businesses work. Everything they get is turned around to pay for upkeep only. Any extra goes to a pool to pay for expansions and upgrades.
I don't know about you, but I didn't purchase my account for wasting my hard earned money on pay to win servers. I purchased minecraft because I wanted to play minecraft.
Exactly. I payed once. ($14), so I ain't paying again. IMO, no server will ever be worth the cost of paying a cent to play on. Donating is one thing. Paying to play, not my cup of tea.

Everyone keeps saying "pay to win." I thought Minecraft was a sandbox game, and thus no way to "win"? Barring PVP and mini games, why should other servers be effected? Unless the server is blocking specific features, survival "donation" incentives are just time savers and take away from the point of the game. If that is the donator's wish, so be it.
Because large servers are expensive.
