Just throwing this out there, but if the paying users keep paying then "insert server name here" will be just fine.
The problem with the above statement is we all know better. Its unrealistic isn't it. The people who paid then and don't pay now were paying not to play the game, but to have a status above others. I would argue that maybe, just maybe, that's what makes the mojang guys cringe.
Except that, that generally isn't the case. Especially in the very large servers, when you pay for a kit, you're paying for a DIFFERENT experience, not a better one. Its akin to say making WoW free to play and charging for a couple of the classes to unlock them, the classes may still be balanced against all the free to play ones, but they're different. In other cases, paid perks help someone with less time to play to grind all day to keep up with those that do. In other free to play games with paid perks I've played, I've actually seen parents pay to get experience bonuses in order to keep up with their children. In either case though, nothing forces you to play there.
That's the key element to this...people keep acting like they are forced to play on these servers or they cannot play at all. That's just not true. If you don't like the experience, join on of the other billion servers being hosted, or even make your own. The only reason I can see to complain about this, honestly, is if you actually want to play on the server but aren't willing (or can't) to pay for the specific feature you want (for whatever reason). And to be honest, that's just greedy.
Why can't you rely on your on money since its your server? Why can't you adapt to the EULA, people can still donate to you, just not in a way that violates the EULA.
I'm willing to comply with the new EULA, but i'm almost 100% certain there are many who wont. This should be interesting, i'd like to see what Mojang does about the 1000's of servers who will simply ignore the new terms. Big servers of course wont be as easy to get by their radar, but what about smaller servers that still pull in a decent amount of donations?
I'm just sitting here, sipping my Coke, laughing at everybody who think this EULA update will automatically mean the end of Minecraft.

If your answers to all of these questions are no, then you're judging the situation far too early. Although, in my opinion, most servers sucked because of the infamous pay-to-win system, none of us know if this will be for the better or for the worse. All we can do is wait.

Every time I DONATE blood, they give me an Orange Juice and a Cookie. So did I just sell my blood for an orange juice and a cookie? Of Course not.
OR If you Donate 10 dollars to PBS you get a tote bag. I can promise you I have never in my life said... OMG I HAVE TO HAVE A PBS TOTE BAG!!!!
Those two groups are Non Profit. As in they can not SELL anything and must be funded out of pocket or through Donations.
While the definition of a Donation is a gift. Majority of Non Profit Organizations do indeed give gifts back as a Thank you for Donating. 90% of those gifts came to them free from another Donation etc etc... They do this to help give lower income people see a reason to donate so that they can justify giving away X amount of money. Whereas those who can afford it may use it or just toss away, re-give to someone else.
Kinda like my local Zoo offers a Donation package that gives them a sticker which makes it cheaper for them to park. Our Zoo is one of the top in the country and completely free because of the donations.
Just because you receive something back from a donation does mean it was not a donation.
Now this can and is being abused and can be seen that way for a lot of minecraft servers.
However you also must realize that the Average age of a Server Owner in Minecraft falls around 13-16 years old. Mostly using their own money (allowance/after school job) or parents credit cards. Odds are they don't know the real difference or don't care.
In the end it just comes down to accountability. IF PBS or Red Cross, or even my local Zoo ever had a complaint about their donations then legally they have to turn over their financial records to be reviewed to make sure they are in compliance with their non profit license.
There is no way to enforce that in this case and Server Owners have taken advantage of the system. Just Google Donator Packages and you will see the first 4 or 5 pages being all minecraft servers.

The angry illiterate versus the developers who waited far too long to point out that something that has become commonplace is based on something listed as illegal in the EULA makes for an exciting read, but none of this really matters until the first server is actually hit with whatever punishment comes from these new rules. Even then, it's going to be an uphill battle for Mojang at this point, but it will be interesting to see all the same.
The real ridiculousness in all of this comes from Mojang's "Everyone needs to be equal!... but no capes for anyone unless we set it up, okay?" angle here. I'm pro-Mojang, but adding this little bit into the mix just cued the circus music.
Minecraft has had some of the lowest quality 3rd party servers I've ever experienced, next to Garrysmod and TF2. People get too greedy, a lot of the mods spoil the game and there's a lot of equality. I stopped playing this game years ago, and only play it very occasionally.
