I strongly feel that the EULA is good if it is only enforced on certain extreme pay-to-win servers. I believe that as long as a server does not offers super op items to donators, it is fine.
Like seriously, how is this a bad thing? The EULA essentially bans pay to win.
Why I dislike pay to win? Without pay to win, you can become the top player simply by playing the game, Who doesn't want that? Why would you want a game mode where you pay money to be better then everyone else? So in the real world people end up separated by who is rich and who is poor, do we really want to carry that over to minecraft via pay-to-win? Do we really want to turn this into a contest of who has more real life money? I play minecraft to compete with other players in my minecraft(engineering ) skills, not see who is willing to spend more money on a server.
Servers will find a way to survive, personlly I will be more inclined to donate to a non pay-to-win server, then a pay-to-win one. Servers aren't as expensive as people seem to think they are, and if it does cost more money then users donate: do what others have done: put up a bar showing how much the server needs to run, and how close donations have taken it to being there. The people that have invested a lot of time into the server will donate to keep it up, those who cannot afford to will not be so desperate: its a win-win.
Personally I think the majority of people who are against mojang enforcing the new EULA are those who spent a lot of money for perks, advantages, and the like, server owners who have been making big $$, or those who mistakenly believe that it will be impossible to pay for servers with it.
Anyways, anyone have a counter point?

After they finish paying off their server fees, they probably do make money from their server too. But isn't that expected? Why would anyone spend that much money and time to make a server just to break even? Even though minecraft was mainly built for "fun," there has to be more motivation than just to watch other people have fun. Without this donation factor, the best servers would have never come about. Servers like mineplex will most likely either become a pay-to-play or just shut down. You can think what you want, but donations keep the servers I love up (even though I have never donated to another server :D).
Ok, I am extremely confused here. Forgive me for not being in the loop, as I haven't played Minecraft or read the news about it for months.
So, I really don't see how any of this is so bad. From what I'm reading, Mojang is giving server owners the option of making people pay to join their servers. That seems fine to me. Yet people say they're going to be "forced" to pay to join? If it's optional, then I don't see the problem here.
But one thing I don't get, I own a local private Bukkit server that I host on my computer. They say it will "affect everyone". I don't see how it's going to affect me, when I'm the only one that joins and plays on it.
The only thing that could affect me, I used to be on a server that I paid real money to get Supporter benefits (perks and helps server costs). I might rejoin it in the future.
The problem with the new EULA enforcement policy is that servers can no longer charge players for perks, eliminating the primary source of their income. Most servers will be unable to pay for themselves with just kindness and colored names alone, so there will inevitably be a whole lot of pay-to-play, which sucks much worse than pay-to-win.
Then I guess my server will be very popular when every other server in the world only accepts people who pay to log on, as I wont be forcing anyone to pay for access on mine.

As long as you aren't giving world edit/world guard access to people that give you money, you can restrict it to staff. You also can't give staff access to people that pay for it.
As for the second post, if you reach a goal, you can reward everyone, but you can't reward just the people that donated.

Only if they payed for there staff rank hehe. Other then that no because every server has to have staff its to much work just for 1 person to take care of all the griefers though if servers go pay to play I don't see many griefer problems being on all those servers hehe no one is going to want to grief if they are paying to play on the server some still might though.
Thats the only problem this EULA update might fix hehe those dang griefers.
I see all servers that are left having to deal with more griefers as there not going to be as many free to play servers for them to grief.
You can assign all the staff ranks and abilities you want based on a person's ability, association (friends, etc.) or because you play roulette to find out who runs the server this week. As long as it is a reason other than the person giving you money the EULA shouldn't be an issue.

Minecraft / Mojang might want to becareful with this topic. www.Minetest.net is still viable opensource / Free option for all servers and players without even the 27$ purchase.

I think your missing my point, regardless of how servers make/spend money, whats important is the players and quality of play. That means change to the current system. Those changes will upset the current balance of things. Again, I, and apparently Mojang, are against servers taking money by giving in-game advantages because it ecourages unfair play. If servers cannot survive without unfair play, then that is the way things go.
Don't assume that minplex, etc will switch to pay-to-play. Just because they can no longer accept payment for perks does not mean players will no longer pay. Those players that would have otherwise bought perks, will instead fund the server to keep it alive via donations. Think about it: you spent hours and hours of time on the server, if you donate what you would have donated for a perk, then the server lives, otherwise it dies. If you were willing to pay that much for a perk, you would be willing to donate at least as much to keep your work from disappearing from server death. Players that have this money then, will donate to keep it alive, and players without it such as kids will get to enjoy it without stealing their parents credit cards. The server will simply have to survive without the kids parents credit cards, which is a good thing.
Personally I don't agree with the way they (Mojang) are handling this but it is time to prune servers such as gotpvp.com from the minecraft community! They have a pay-2-win scheme an example is that if you want access to the /back command on the faction server you would have to play for a donor rank, it doesn't just stop on that factions server they have but its pay-2-win for all of their serves they run.
What measures can mojang take to actually enforce any of this against a pay to win server?
It is called a cease and desist order, also they would normally send that to your host, or if you're your own host they can report it to local law enforcement and or your ISP (internet service provider). If you don't know what a C&D order is, let me link you a video briefly explaining what one is:

As per advertisement Elua states nothing about ads so in turn you can most likely (correct me in the case that i am incorrect) use one of the following methods to obtian a profit or funding for and from your server.
Use a resorce pack to administer visual verbal or a mixture or the two to provide an ad
Use ether a plugin or game modification to administer visual verbal or a mixture or the two to provide an ad.
As per my standing on this new event the statments released by the staff concurent to the date of realese. I am "the five in between 0 and 10" due to the fact that I do host a server for this game but also enjoy playing on other servers and just find it anoying to see other players who are both monetary and virtual classes ahead of me and other players due to there monetary inclined position.
So would a currency boost (I fixed your typos) provided to all players in a group bought by a member of that group be ok?
