If the name you pick for your game is used in whole or in part by other people, you can use your trademark to force them to change it.
So I can call my game "Shadowcraft" if I like. If it's about building, digging and magic, then Notch will use trademark law to tell me to change/pay a fee, and I probably will. If it's about magic and is an RPG, they'll lose the suit completely, but the trademark lawyers still have to make the attempt.
It's about context. Given that nearly no info is known about Scrolls at the moment, this is the best time to C&D Notch over it.
The chain of games is called "The Elder Scrolls" compared to the game "Scrolls". This is obviously similar. TES is a first person RPG set in medieval environs with some magic. Scrolls is essentially a TCG set in medieval environs with some magic. Again, similar.
This is plenty enough to lodge a trademark infringement notice. Whatever the outcome, it is quite likely that Scrolls will still be Scrolls, and all the butthurt in this thread is exactly the same as every other media-hyped trademark case.

I understand copyrighting MineCraft. What is illogical is copyrighting Mine or Craft. You shouldn't be able to copyright common words. Scrolls is a common word. Elder is a common word. "Elder Scrolls" put together is not.
Using your logic, I could copyright the word "Call" and sue anyone who dares come out with a Call of Duty game.
I agree that this whole issue is stupid but it shouldn't be blamed on the developers of the game. They are NOT the ones who are suing Notch and Bethesda (as a gaming company) is not really who we should blame. It's their lawyers doing what they think is best for the company. Now if Todd Howard and the rest of the devs start taking this seriously, then I will definitely lose respect for Bethesda.
Okay, so lots of us know that Bethesda is ordering a desist on Scrolls, the new game that Notch and the crew are working on. From the forums though, I can tell a lot of you didn't understand what ACTUALLY happened with the lawsuit.
Bethesda was not saying that no one can use the word scroll, ever. They were saying that a game titled Scrolls was too close to their Elder Scrolls title. This would be similar to a game called Crimson suing a game named Maroon. They are both similar titles and since it's just a different hue, it's very close.
The people at Bethesda actually love Minecraft and play it all the time. When Notch and Todd Howard interviewed each other, there was no animosity, and they both saw each other as equals. Like Notch said, it's lawyers doing their job. You shouldn't blame programmers just for working at Bethesda.
I propose this, you all follow the links to find out what's in the next news story and learn to find all the facts. Knowledge makes the difference between a fool and a wise man. Do anything you can to learn the facts before you say stupid things like, "Oh, I guess I can't say the word 'Scrolls' anymore or I'll be sued."

Chances are the programmers over at Betheseda have had barely any time to react to this. You could say that they should be doing something about it, but nobody can accomplish anything in such a timeframe. Also,

They will never get it. EA is a money *****. If they did get minecraft the price would be 50$ and you would have to pay to change your skin or something.
Right now with everything thats causing mass panic in both The Old Republic and Diablo III fans, it seems EA and Blizzard are having a competition to see "WHich game company can outdick their consumers and get away with it"
Nice. Now, if minecraft was developed for consoles by Mojang that would b kinda cool. I think it would make online play easier, kinda like Halo custom match....

Because the lawyers don't work for Bethesda, they work for Zenimax Media, Bethesda's parent company. So Bethesda themselves have no control over this.
You should learn all the facts before you start throwing accusations around. If you want to blame somebody, blame Zenimax.
