Yep, one of my hesitating reasons originally for not purchasing the game earlier. However, in order to cover his butt, he's going to be spending hundreds of thousands of dollars on lawyers, paperwork, etc to cover his butt incase he decides to jump ship and leave thousands of people hanging with a product that originally promised but failed.
Hope that doesn't happen though :<
