Sadly not only is modding illegal on the console it's impossible. PC mods are easy as the game is coded in Java and is open to editing however the consoles run a C++ version which is not open to modding.

You CAN put mods on the console, but the only way to do it legally is to prevent users from adding new stuff. This means that mods only play with the NBT tags with stuff that is already in the game.
Mods are legal, if they werent then Bethesda would not be able to have them for Skyrim or Fallout.
YYou are not allowed to modify your XBox, but this isnt what we are talking about here, this is basically User created/manufacturer approved DLCs. Unfortunately that "mod" flag will prompt ignorance and close thread, oblivious to the actual meaning

Are mods legal now? My daughter really wants to try to put a mod on our xbox 360 but I don't want to risk our account getting suspended.
