This has been happening for a while, but I kept thinking that the updates would fix it.. I go to buy skins or packs and it legit just tells me that there's none available.... This has been happening for months now..
Go into the marketplace through the Xbox Live main dashboard instead of from within the game. If that doesn't work, you should probably contact Microsoft about your account status.
I've had the same problem. It does intermittently reappear as I just purchased a mash-up my son wanted and it took me a couple days to be able to load the game and get it. I was figuring the same thing. The update would fix it, but no.

Another thing that does occur from time to time are issues with Xbox Live itself. The status of various Xbox Live services at any given time can be checked at this website:
Personally, I've never had an issue but I buy everything through the Xbox Live dashboard, not from within the game. You can also make a bug report if you wish:
