I'm going to risk answering this. And I am in no way endorsing or condoning this. You can mod, meaning you are physically able to. Don't ask how and don't plan on hooking up to Xbox Live ever again if you do.

If you're asking if there is a circumstance where Microsoft allows modding on the Xbox, the answer is no, they don't. If they catch you, they have the right to ban you, period... it's written clearly in the TOS. Do they catch every instance... no. However if you're unwilling to take the risk of "doing the time" don't do the crime. People get away with things that are against the rules all the time... that still doesn't make it allowed.
Is it possible to break the Microsoft ToS without getting caught? Probably. It's also possible to rob a bank without getting caught, but I really don't recommend it either. Also, discussing how to go about this is not permitted in the Minecraft Forums. And before this thread gets any closer to that point, I'm locking it.
The answer is: why would the risk be worth it?
