I know on the pc that mojang doesnt have a problem having a map that u made available for download..... but what about for the xbox 360 version? because i know microsoft might have some beef with it. this is purely a hypothetical question and if someone could give me a link for this off the mojang or microsoft websites stating whether or not a person is allowed to i would really appreciate it thank you

The biggest difference is PC is a open platform that people can tinker with, and Mojang allows people to modify their game on the PC.
When we look at MCX360, yes, the game is still owned by Mojang, but Mojang does not develop or work on Xbox360 system itself. So when it comes to what is and isn't allowed the console itself is up to Microsoft and not Mojang.

Like the new article a few weeks back about Putt Putt Minigolf sending out a letter to tell Mojang to stop using their name in Minecraft. Mojang does not endorse or create the minigame in question. Users created it and used the name within Minecraft, and because of that Mojang is not responsible. It's the same for skins. Mojang doesn't create skins. Mojang let's users upload skins, but does not have anything to do with the creation or the manipulation of the look of pixels on a user's avatar.

Possibly, out of respect for 4J's participation here and the participation of the community itself? This is the forum solely for the Xbox Edition and the rules Kioribug has mentioned apply only to this section of the forums. PC Minecraft players can discuss mods and such in their own section because Mojang has given it's permission for the PC Version of the game to be modified in an "open-source" fashion. They give modders the code and API for them to do their mods.
Mojang has not extended that permission to people wanting to mod the Xbox Edition (because doing that would probably violate their agreement with Microsoft and land them in a bunch of hot water). They have not given anyone public access to 4J's code for the Xbox, nor has 4J, and nor has Microsoft. If community members are modding the Xbox Edition, they are doing so without obtaining the code to work with through legitimate channels. Their stuff is, therefore, not authorized... and using it on the Xbox or on Xbox files clearly violates Microsoft's TofS. If, someday, 4J, Mojang and Microsoft agree to provide the community with permitted access to the code, the situation may be changed; but not before.
The community here on this forum consists of people who are (or should be) bound by Microsoft's TofS. They agree to that ToS when they play on the Xbox, period. Therefore, I agree with the policy to follow Microsoft's ToS here.
We do have a number of interlopers who come onto the site just to stir things up who have probably never played an Xbox game in their lives; but that's a different problem... and the number of locked posts reflects, in part, that problem.

No, of course not. But in order to play your games on a console other than the one that owns the license, you need to log into XBL with the purchasing account. If that account is banned, you can't log in, and you can't play your games there. You can only play them offline on the console with the license for that game.
Remember, games are dongled 2 ways: (1) by the unique ID of the console where the game was initially purchased, and (2) by the purchasing account. Either one alone lets you into your game. It's a terrific DRM system, really. Best of both worlds.
