Am I missing something? Also...its a building game. There is like thousands of pixle art that 'breaks' copy right laws right?
I dont want to be "that guy" but is this just to make a little extra income? I have no problem with that. I buy all the skin packs regardless. But I'd like my own that are unique to myself.

If they'd given players the opportunity to make their own skins we'd probably get a lot of Mario and Yoshi, ps3 exclusive figures. Ergo, Nintendo and Sony could sue them for copyright for allowing them to allow us to make them on our characters. It's different for the stuff people make in the game because Microsoft is no producing what we make in game. There is just no way for them to do that. They would however have control over our skins by allowing us to make them. Hope that clears things up.

Microsoft is a company that makes consoles. They're rivals to other people who make consoles. (Nintendo-Sony) On the PC people make skins which were originally mods. To my knowledge the PC is it's own section when it comes to gaming. Something that is xbox, Playstation, nintendo exclusive does not apply to PC. Unless it's "only on the console version" kinda thing. Mojang is not a product of any company therefore they don't need to abide the same copyright laws as others on consoles. Plus, like I said skins are technically a mod made by people for the people. They've just made it easier for people to have them
Custom Skins aren't going to be implemented. Reason: Because some players would make Mario skins (for example). Since the Mario Franchise is Copyrighted and owned by Nintendo, if someone were to make a Mario skin on the Xbox 360 Edition of Minecraft, Nintendo can have the right to sue Xbox.

The reason it's not a problem on the PC is because custom skins on the PC is a mod of the game, not an actual feature of the game itself. If Mojang added an official skin editor and let people create Mario skins, then it would be grounds for a lawsuit.

I think it's simple, the main reason is: money.
If people can make their own skins, they won't buy the skinpacks.

The developers of Soul Calibur got permissions from those other companies to use those characters in their game. The game developers can gain the permissions, but it usually requires some form of royalty paid to the company who owns that game. Microsoft really had no say in which characters they choose, since the developers went through the correct channels to gain access to those other characters.
For MC to add in a custom skin editor they would need to somehow prevent "adult" skins from being created, and 4J/Mojang would need to jointly gain permissions from EVERY company to gain access to their characters, on the off chance the users decide to create a skin based off some obscure game (maybe you want to create one of Kain, from the PS1 game Legacy of Kane series, i've only played the 2nd game myself, but it was surprisingly good for a fame i never heard of before finding it for $1 at a garage sale)

They paid nothing due to the custom character creation which enables the Soul Calibur community to create anything they want including obscene characters that do not bear mentioning (which can actually be flagged as inappropriate)... I myself have created everything from Spiderman, Batman to Margret Thatcher and Hulk Hogan. It could be easily implemented in my humble opinion.

You can do the same thing in most games that allow you to make a character. However, it's not the actual character model. Minecraft would not be either, but I have an assumption that Microsoft would intended to Sell a skin editor which is a massive difference to an editor being part of the game already.

If they gave you an editor for your character, most people, like me would not bother buying skin packs because I could have fun making my own and /or any character in the skin packs they already have on offer. You didn't get my point. I didn't state it was better for business for them to release a skin pack. I said if they'd release a skin editior they'd most likely sell it as an add-on for the game. Therefore by selling it to the community they'd have to be held responsible if people make skins that dis-avoid copyright.
Your analogy for a custom character is like the same thing Minecraft is. Someone in game could make a mario pixel art, but that's there doing not the game developers. It's part of the actual game and not something they'd probably intend to sell.
SIMPLE FIX. Require custom made skins be reviewed before letting us use them, if some dumb kid makes a mario skin, don't let them use it. If they just had a program that would match pictures to skins like say compare a mario pic to a mario skin, then that would allow easy control over that issue and us mature people could enjoy custom skins.

Hence me saying "if they had a program that could do it by matching pictures to skins". Considering face recognition technology exists, it shouldn't be hard for a program to compare two things and go "yes" or "no".

I'm not sure that the character model and the pixel size of the skins would exactly make for incredible likenesses on the scale that image recognition would require

you'd be surprised at the amount of detail is in some of the skins... i know to get the red/blue Spartan to look right as pixel art you need a minimum of 16x16 for the head alone, and that's cutting it down to max pixel-a-tion... a 64x64 would probably be best to get all the details correct TBH.
