if u make a tower from bedrock to the ceiling and go halfway the vertical rain doesn't hit anything but still makes sound. so its not those particles making it.

Then that is a bug. However, your original post is not. Rain only makes a noise when you are extremely close to the ground. Most likely within a 5 block range. This is most likely due to most of the sounds being severely nerfed on the Xbox 360 Edition.
For example, on the PC version, Noteblocks and Jukeboxes can be heard from about 70 block+ away. On the Xbox 360 Edition, Jukeboxes can only be heard within about 15 to 20 blocks and Noteblocks are even shorter range.
Rain is too loud at the best of times. I actually like MG's first explanation and don't mind at all that you can't hear the rain unless you're close to some blocks... anything to deaden the roar a bit!
