Black Ops is still a perfect example. Even if you give them a rudementary set of shapes or colors then they'll make perverted or nasty stuff. The reason its not such a big deal is because Black Ops is already an M rated game, whereas Minecraft is like E 10+ I believe and thusly they have to follow some rules, thats why the censor signs
I don't think that's the primary reason for skin creators not being added. You can already make perverted creations in Minecraft. A friend of mine has a ton of naked chick pixel art pieces. I think it's more of an issue with the fact that nobody will buy skin packs if they can use an editor.

Do you have a source for this? If this was true, skin designers would be getting sued all of the time. It's impossible to create an exact likeness with a Minecraft skin. I believe it would fit under a reinterpretation, or at least some sort of gray area.

Actually the skin creators are typically average people with average income or none at all so thusly sueing them would be more costly to the company, they cant sue Mojang because the skin isnt being hosted by Mojang like it would be on xbox and sueing Microsoft or 4J could earn them a good amount of money.

Average people are sued all the time. If they can't get the money, their possessions can be claimed. Someone just isn't violating any copyrights by reinterpreting a trademarked image. Haven't you ever seen knockoff products? Like the costume masks that are obviously portraying a celebrity, yet they use a generic name such as "movie star", "politician", or whatever. I doubt the owner of the business producing these masks has an average income.

That makes no sense! In skin pack 3 they added a Bit Trip Beat skin. That is by nintendo and Guy gamings (something like that) and they didn't get sued! Copyright is so confusing

I was wondering maybe we can have customizable capes? I think it could work just like emblems from Black Ops. They were able to make in-game custom emblems so I think we can make our own type of capes using something similar to the black ops emblem creator. Well toss around the idea and if you don't like it than you find a way to make it work.
Something like this will happen in the future, it will just make it easier to identify certain players as well as any customization that a player can do makes the game just that little bit better. I think they need to have shields and put the emblem on that instead.
Capes were said to be a special piece of your Minecraft Character and not for everyone. Just those who help, attended at Minecraft Events and just maybe delivering Ray Cookies.
I personally don't think we should all have them and they should stay special to those in the community who deserve them. (And about the Beta and Alpha Capes, probably not happening now...) Of course, this is my opinion and I can't say what will happen in the future but I just don't think it will happen. And I think you should work for it. Like at Mojang, they work for there capes (probably not...) and you work to get off your chair to head to Minecon and that takes a lot of skill...

Dude. First off, Microsoft will sue Mojang and 4Jstudios for not having enough money. Having P**n or S** (You know the rest) on a cape can be bad for younger kids who play the game. I have a friend who's brother is 7 and he plays Minecraft. And knowing our trolley internet, you can't trust them. And skins, we are on the topic of the XBOX. Not PC now. Look at the forum section. So, that's why 4JStudios has to release skin packs cause due to people using Halo skins without permission. Now on the PC, that's different. PC Gaming is considered different than XBOX gaming. Microsoft doesn't control what gets released on the Interwebs. Now I know I just spoiled your dream of becoming a genius cause you are trying to use copyright laws but those laws are probably from 1919!
Anyways, I'm not saying it won't happen in the future, just don't expect it.

All of these examples are Trademarks, not copyrights. No Trademark falls under fair use. Ever. For example Mario is a trademark of Nintendo. You cannot use Mario for anything without written permission from Nintendo. Profit does not figure into it at all. The way Trademark laws are written, a holder of a Trademark must aggressively defend it because if they don't they lose the rights to that Trademark.
Copyright is for written works, songs, scripts, works of art, etc.
Trademarks are for logos, icons, characters, and anything a business uses to establish it's identity.
The differences are hard to grasp, but consider your average 20 oz. of Mt. Dew. Not only is the Mt Dew logo Trademarked, that whole entire label is copywrited as a work of art and can't be reproduced.

I'll ignore the majority of the issues in your post in order to favor one. Microsoft/4J would be doing exactly what you said would make it illegal: making a profit. Do you think the skin/cape creator would be free? Haha no.

How about shoulder pads, bigger arms/legs, more "serious looking" armor, stuff like that? As skins they would be easy to add.
