i have a texture pack i want to release here but i’ve had trouble with the moderators in the past because the pack had textures that were not considered “original” enough because they were edits of default textures.
before i go to the trouble of posting i wanted to check and make sure that the textures i’ve made are okay to release, that this time i won’t encounter any troubles. could a moderator or someone who knows what they’re doing possibly help me out?

However, what sixfootblue said is correct. You should already know if you edited another pack or not. If ALL of the textures were made from a blank canvas then it's fine and you can go ahead and post it. If you took another pack or the default textures and made changes, then it isn't. This is really basics of copyright. If you didn't make it, and don't have permission from the original artist to edit it, then don't distribute it on the Internet.
I mean. Did you make all the textures in your pack from scratch, or have permission to use edits/textures you didn't make?
i hear "from scratch" and it makes me wonder if a new layer with the original below for easy reference counts. confusing technicalities there. i'm having alvoria deal with approving of it, but i have done a LOT of work to keep the textures basically default while still setting themselves apart.
by the way, your packs are AWESOME and they're really big inspirations for me. i'm eventually planning on examining how your itembound pack works and making my own textures that can do things like that, too! and with loot tables man, i could do a loooot to... all future plans, i kinda just wanna get this finished so i can stylize things in default style without having to run into the whole copyright thing. minecraft textures are fine on their own, they just need more variation. that's my goal eventually. you've done a great job with that, man.

It mostly seems to me that this site in particular might be making a profit from traffic and revenue from clicks to your posting of these derivative assets, and thus against Mojang Rules and of these forums.
That's my view on this, I'd love to be corrected.

Unfortunately in their effort to be unambiguous... Mojang was still ambiguous. For instance:

So far as this forum goes, we assume that "purchasing the game" is both fair and reasonable as a requirement to gain access to the game's assets. This is combined with further points that state you must comply with the EULA which itself is actually far more restrictive and says fairly unambiguously that you are not allowed to distribute anything that Mojang has created without their permission. So the two rules sets clash.
Mojang has also had freeware projects taken down which use de-obfuscated Minecraft code in them, in spite of code being specifically mentioned as an "asset". Thus there is precedent to assume that Mojang is NOT OK with people redistributing things they've made... which is backed up in the section about noncommercial uses:
We are very relaxed about things you create for yourself. Pretty much anything goes there - so go for it, have fun, and just don't distribute anything we've made.
Emphasis mine.
Unless we get an official statement from Mojang, we're going with the DMCA Safe Harbor provisions and removing material that we believe to be in violation of copyright. The DMCA is the relevant law in the country where this forum is hosted (US of A), so it's what must be followed in absence of other concrete information.
Other sites have their own policies and their own takes on the issue. Feel free to post all of the potentially copyright-infringing material you want on sites that allow it. Just not here.
My main reason for questioning this is that released textures that are completely non-commercial that have been modified from original textures; cannot reasonably be made into the same original texture, a hue/saturation change to a texture or significant modifications off the base texture. The effort requires to take those modified textures and make them into their originals is equivalent - in my view - to taking a custom texture and making it the same as an original texture to the nearest pixel.
I get not distributing the actual original textures, but it seems less reasonable if it's a non-commercial modification of a texture. The distribution isn't of the actual assets, but textures that require work to make into original textures; similar to all other textures.

PineappleWitness; the jist of what Alvoria is saying, from reading the EULA and Mojang's ToS, then no... if you use the original texture as reference, even in your new one... your new one has to be different enough to not look like you drew over it, copied it, or modified it- and needs to be removed from the texture and from the pack if you want to share it.
You CAN, using your own art skills, make something similar- but be weary and mindful.
Take my pack for example... my Soul Sand? I really liked the original concept and design, but I still redrew the whole thing myself, using the original as reference- you can SEE that, but you can see that I put effort into my own work and didn't just copycat the original.
I know Alvoria will agree with me when I say that you shouldn't let impatience drag you down- if you want to make a pack...make it YOUR pack. Put work into it. It will take time, yes. It may be frustrating at times, yes... but you'll be so much more proud of yourself playing with a pack you put all that effort into- and others will commend you for the effort as well. :3
