Yes. Resource packs, like any published artwork, are protected by copyright law. Check the DMCA if you're in the US and the Berne Convention for most of the rest of the civilized world. If you host a resource pack on your server in violation of the copyright holder's license, they can contact your server host and have it removed. If you host the pack on another service like Mediafire, a DMCA takedown request can be filed to have the pack removed. Really it just depends on how far someone is willing to go to get their work removed from unauthorized sources.
Mojang doesn't hold any copyright over anyone's resource pack, save for the default textures. The Minecraft EULA states they have the right to use anything created for their game, but that's not the same as them having a copyright to a pack. Rather, by making a pack you're agreeing that Mojang has exclusive license to use your pack. It's a small price to pay, and doesn't interfere with copyright in any way as that's an exclusive and separate agreement between two parties.
