you cant play on a server with an hd texture pack. well you could but some of the blocks are messed up.
A texture pack effects how blocks are shown locally.
If your minecraft client is showing messed up blocks, you will need to use the MCPatcher on your own Minecraft.
Using it on a server will do nothing, as it is not the server which is showing the textures.

the game wont let me log in when i try it on a server. it says "user is not premium". if i unpatch i can log right back in.

When you patch your game, are you running from the original minecraft launcher, or the 'test minecraft' button in the patcher?
Because you do not log in when you press the 'test minecraft' button.
You need to close the patcher after patching and open minecraft normally.
