I'm planning to make a mod Fancy XYBlocks It should be based on the myth known XYcraft. It's going to have fancy blocks based on the design of the xychorium blocks (refrence pic: http://i.imgur.com/ANHfJ.png ) and the tanks (http://i.ytimg.com/vi/SErO9FaqbIQ/maxresdefault.jpg) the tanks should be able to consist of any blocks with as borders (except some ridiculous ones like sand and dirt) as long as it has some glass and an Tank GUI block.

Then make a mod that isn't blatantly ripped off another persons idea.

You understand that the Xycraft you used back in 1.4.7 was a WIP piece of trash. Soaryn was asked to give people a WIP apha mod. A lot of it's features are still the same to this day. Just because you can make a mod that does the same thing. doesn't mean you should.
I'm not defending Xycraft i'm defending the fact the idea is already taken. Be original in the approach and come up with something better then xycraft. Instead of actually taking the idea and simply ruining it. Believe me you'll save yourself so much trouble if you just drop Xycraft and simply do something else.
In OP's defense, he's not really ripping off someone else's idea for his own gain so much as he just wants access to the awesome blocks and is tired of waiting for something that might not happen. I too really miss those glowy blocks and even though Chisel has some neat things nothing quite compares. ^^

The thing is he's still taking credit for an idea belonging to Soaryn (and Chicken Bones respectfully), IP does not just cover content, it also covers ideas. What would your defense be if you thought of an idea, acted on it and discovered the cure for cancer, then out of the blue you notice someone else has secretly stolen your research (an ex-employee perhaps?) and published it themselves, taking all the credit? It was your original idea and it was your intellectual property. Same can be applied to this scenario.
Soaryn thought of an idea, worked on it (and in Soaryn's defense people kept badgering for a release when Soaryn knew fully that it was way too early but reluctantly released a WIP build for those who wouldn't stay quiet), and then seemingly abandoned the idea, for all we know he may have been revising a lot of his concepts for the mod and just never told anyone. Then, out of the blue a developer full-knowingly and admittedly steals the idea and takes the credit for it.
In the OP's defense, you could compare this to RedPower and the various RP2 clones, but the difference is in that scenario the mods are different in terms of concepts, each mod adds a new idea to the plate for the mod as a whole and makes the clone different to RP2. The OP doesn't seem to show any deviation and is literally copying the mod for the sake of missing functionality provided. That won't hold up in a court case with a major company suing another, so why should it here? Food for thought.

well, time to tear-down this argument: and fair warning: i will be blunt AND harsh about it.
I used to very much believe in the idea that copyright is a GREAT thing, and furthermore that piracy/"plagiarism" are TOTALLY unacceptable.
It is true that the argument you have presented happen(s/ed) Many times. And actually, this strengthens the point I'm gonna make about the dangers and EVILs of copyright,trademarks,etc...
Last I checked, the mod cloners do not out of the blue pop-up and take CREDIT for mods or their ideas. They just do as any normal fan project would, and try to revive the game/mod. Or, people try to clone programs to learn from/teach about making an app like that. As for the stable/unstable release thing... ugh... it's not just THAT, he's adding WAAAY too much stuff at once, and over-burdening the entire project.
Ok, so, let me present an ENTIRELY plausible scenario which in WHOLE, proves the problems with people taking exclusive ownership over an idea. I create, oh, let's say a mod all about cats. You create a mod all about cats. Now, something, either our code , our graphics, the idea, is virtually identical. maybe even the whole thing! (THIS is unlikely, but there's still a small fraction of a chance it CAN occur) Now, your mod is copyrighted, mine isn't. Well, you find me and sue me, cuz... it's "your idea" alternatively, BOTH of our mods are copyrighted. Now, in the end, there will be a crapstorm, hurt feelings, and one or both of us is getting SCREWED as hard as is possible. Also, if ideas can be copyrighted (they cannot) , let's say the CTM mod were to die-off. By your logic, that means that if I make my own version, I'm breaching copyright. It also means, ofc, that CTM would stay dead and many a texturepack/mod author would be pretty unhappy with this.
Also, soaryn's "original idea" ,well, umm... most of the core concept isn't particularly new at all...
new ores: most of the mods have these
liquid tanks: almost EVERY technical mod
redstone-activated light sources: minecraft, itself. and redpower has/had them in multiple colors, also...
multi-block structures: nothing new
hexagon-based patterns: sci-fi and high-tech genres use them a LOT
wireless energy relays also have a place in sci-fi...
the fire basin, at least at the time the mod was still considered active, was nothing more than over-glorified netherrack

The glowing/shiny blocks this mod adds are about all it has going for it that really can be preotected, and even THEN, the frame textures for all the different xycorodite blocks really aren't unique enough to warrant anything. Although their base texture most certainly is.
And again, none of the idea here can be EXCLUSIVELY owned by any one party.
That being said,, so long as this project does not use the original code or graphics, then it is ok.

You want to talk about unethical/illegal/immoral things, scams/fraud/money laundering all apply. To be getting money from people expecting something in return, and not give it to them, or anyone else for that matter, is wrong. It is 1000 times more wrong than any level of copyright infringement will ever be. (or at least, any of the normal stuff copyright holders get so paranoid about) If he finishes Xycraft, fine. If not, fine. But, if he's not going to release anything, he better stop taking money for it. But really, that mod has missed SEVERAL major updates, he has failed to post any kind of release or REAL progress update the whole time.
Lastly, I''m SICK of every fan project lately getting accused of copyright infringement or being served a nice C&D.

Those whom even are meant to be making money don't need to hide behind some legal shield entitling them to exclusive usage permissions for ANYTHING, and the immoral/unethical right to sue/challenge anyone who allegedly breaches these rules, often for several times more money than they actually lost, if any at all. If people are going to continue to abuse the power copyright grants them, then I personally believe we're better off without it. I will ask nicely this time, but please take your copyright stuff somewhere else, because no one here is interested.
Also, nowhere did I see it stated in this thread that credit would be taken, nor given...
So really, so long as they don't use any of the original code or assets, and mention soaryn, there's nothing wrong.

I learned about this mod too late is the problem.
And not only that, but my computer was having, and keeps having, problems.
Kinda hard to play with mods or even vanilla mc when such issues as that are in one's way
