I can't see anyone selling them. Adfly just gives you money, but noone loses it.
Posting an adfly link forcing you to click it so they get paid is charging for the mod. It doesn't matter who is paying them, be it you or adfly, it is still charging for the mod which violates the Terms Of Use agreement the developer ACCEPTED when purchasing minecraft. (Unless of course they STOLE the game to start with and then began developing mods for it to make money from a game they stole)
And I have no real issue with using adfly to help them for their time (as I am unemployed and have 5 mouths to house and feed with what little i can make which stops me from being able to donate to them directly). What I CANNOT stand are the ones who deliberately create an excessive number of so-called modules to the point where you have to click through over a dozen links to get everything that goes with the mod.
Accepting donations for anything and not reporting it to your local authorities (most times local state police) is illegal. It is also illegal to accept donations from streaming or posting videos on youtube or accepting donations for servers without claiming them as earnings on your taxes...
Eventually these people who do this will end up like megaupload with a confiscated website and several outings to court/IRS office...

Who is to say that these people live in a country that has that type of tax system? Or even better yet that they don't claim the income in their taxes. I am subscribed to a few Youtubers were their primary or only source of income is Youtube, Its called entrepreneurship.
If you've bought the game, you may play around with it and modify it. We'd appreciate it if you didn't use this for griefing, though, and remember not to distribute the changes. Any tools you write for the game from scratch belongs to you. You're free to do whatever you want with screenshots and videos of the game, but don't just rip art resources and pass them around, that's no fun. Plugins for the game also belong to you and you can do whatever you want with them, including selling them for money. We reserve the final say regarding what constitutes a tool/plugin and what doesn't.
Minecraft.net said that you could sell mods for money from 2009 until ~November 2011
Minecraft.net says (since ~November 2011) you cannot sell Minecraft mods
Mojang.com has said (since the terms were added ~March 2012) you can sell Minecraft mods.
They are putting up links that lead to ways to "donate" to modders and direct links for cheap bastardizing people like you who won't take 5 seconds to support hundreds of hours of free work.
There is a difference.
What kind of lifeless person expects money for mods anyways? If they want money for the game, they should join the team! Or, better yet, make their own game, or get a job! Expecting donations is just ridiculous. People already bought the game. It's fun enough for them. And you expect them to pay... For something that's free? The only bastardized people are the ones who expect money for that. If you make mods, make them for fun.

We reserve the right to change this agreement at any time with or without notice, with immediate and/or retroactive effect.
Any suggestions made are assumed to be offered for free unless otherwise agreed before the suggestion was made. We're not going to put up a huge EULA. We're trying to be open and honest, and we hope people treat us the same way back.
If there's anything legal you're wondering about that isn't answered from this page, don't do it and ask us about it. Basically, don't be ridiculous and we won't.

TOU is retroactive, therefore the selling of the mods are plain stated as being illegal.
And, no matter what Mojang says, you purchase the game from Minecraft.net therefore the Minecraft.net Terms Of Use take precedemce over Mojang as Mojang is NOT selling the game.
Well then call it a business if you want, they still need to obtain a business license, tax ID, and report earnings...
Granted laws outside the US are different, but there are actually people in the US that are doing it...
Edit: I run a business from my home, I have a charity for the little league and pop warner football team in my town. I have a site with a donation button, In my state I am required by law to document it all... I am not some random troll spouting off, I do actually know what I am talking about.
I feel like it falls under the same tax laws that cover the people who make there income from selling stuff on ebay. Although I could be wrong. I have limited knowledge about such things.
EDIT: After thinking about this more I am very intrigued by what would be the correct steps in claiming income from such activities and the type of documentation you would need to get.
'Bout the adfly thing -
adfly PAYS them for using adfly. adfly is a site that does ads on the 'wait' to make money from the person putting the ads. It isn't charging for your mod. Adfly is a company, in which they pay you for using their links.
Posting an adfly link forcing you to click it so they get paid is charging for the mod. It doesn't matter who is paying them, be it you or adfly, it is still charging for the mod which violates the Terms Of Use agreement the developer ACCEPTED when purchasing minecraft. What I CANNOT stand are the ones who deliberately create an excessive number of so-called modules to the point where you have to click through over a dozen links to get everything that goes with the mod.
I have yet to run into a mod OR plugin that FORCES you to use an adfly link. Every single mod I have used (that is also a known mod. We are not referring to scrub ass people changing a variable then posting it up on adfly since those are removed fast as ****) has had TWO links every time:
One is ALWAYS a direct link -- these are used by people who either a: Lazy, or b: downloaded using the adfly link before and now want a quicker download.
The other is ALWAYS an adfly or other form of monetary link that people can CHOOSE to use to help support people who have put their time and effort into creating modifications for the game. Otherwise, the forums would NOT have an ENTIRE section devoted to the modding community.
People are also not PAYING for the mods. They are also not making money from SELLING the mods. There is a very clear difference between an exchange of money from a party purchasing something, and clicking on a link which generates a fraction of a cent each time it is clicked, from a company that has absolutely ZERO involvement in minecraft.
Therefore, people are not profitting from Mods, they are profitting from a company which is paying them to have people advertise on a download page.

Look adfly is just paying the person uploading for making another user go there, whether or not its a mod for minecraft or a picture of a cat is irrelevant.
You the user downloading the mod is not paying a cent so its technically not selling mods. All it is, is well placed advertising so a 3rd party company can pay the modder for advertising. What the minecraft user or anyone else downloads is irrelevant to the matter.

Love how you ignored most of what I said and replied anyways.
I also said adfly isn't selling a product -- it's advertising. If you don't know the difference, you're an idiot.
Incase you also didn't read the other part of my post -- The forums have a dedicated moderated section -- moderators do not remove mods that use adfly links.
It's not illegal to use adfly links.
End of story.
It's why Notch HASN'T had a lawsuit filed against the forums for hosting a subforum which hosts millions of links and mods.
Posting an adfly link forcing you to click it so they get paid is charging for the mod. Unless I missed something, you're not being forced to do anything. Even if various blocker addons for most browsers didn't make ad.fly an easily avoidable joke, these mods are an optional part of the game. If you don't want to support the mod author using these links, don't click 'em.
Furthermore, you're not being charged anything. Ad.fly doesn't debit your bank account directly. The only thing you 'spend' is 5 seconds of your life, perhaps a tenth of a calorie clicking a second link, and about 80Kb of bandwidth. I hope you've budgeted for all this.
I'm not in favor of ad.fly, honestly. I find 'em annoying. But not as annoying as people acting like there's a gun at their head to get a user-made addon.
your all a bunch of noobs they dont make you pay to get the mod.... they use a link its advertising not illegal no body loses money but the modders make a tiny amount of money.
i happily download with adfly links even if they do have a direct one because the modders should be supported for what they have accomplished modding is no simple thing it takes alot of work and you need to be very smart to understand code.

i think this topic should be shut down.
If you read my post from early, idiot, you would have noticed that i don't mind clicking an adfly link to download a mod. What i do detest is BEING FORCED to use an adfly link to get a mod, especially when the mod author hosts the mod on their own computer which they KNOW LACKS the bandwidth to handle the traffic and you end up with one person having to click the adfly link multiple times just to download the mod. That is being plainly greedy and outright disrespectful to the rest of the community.
If the mod author has both a direct and an adfly link, I have no problem with using the adfly link. I simply DETEST being FORCED to use an adfly link.
And as such, with your comment, I think you need to be shut down.
IF Minecraft claims it as a terms of use rule, this doesn't mean its Illegal! It simply means that if you are caught selling plugins/mods Mojang will permanently disable your gaming ability!
