After reading the first three pages of this, I've decided that PimpChimp really is a child and should likely be ignored. And second - What about the gray area mods are already in? If Notch himself isn't even sure if mods are legal, how can anyone presume to take legal action? I know it would be under copyright infringement, and/or plaigerism (stupid chrome wont fix this...sp sorry), but none of 'us' modders have any kind of copyright, and Notch isn't even endorsing the whole thing. So if the dls are not removed, what course of action IS possible?

The one I've taken. This is not the only illegal act the site has made, and any illegal activity of any sort breaches their host's TOS.
Ok. That makes sense. Because everyone was talking of suing - and while the mod you made is yours, minecraft is still Notch's, so it would be...interesting to say the least. Hope it gets taken care of soon.
Guys, you can get tor or use proxies to get around the ip ban and view the site. Theres an entire thread that gives out cracked minecraft accounts, which is actually just a safe link to cracked minecraft clients. It is also stickied. http://www.gamekiller.net/minecraft-gen ... count.html
edit: if we can prove the Intellectual Property thing, we got them nailed. anyone got any ideas?

That's huge. Nice find. Now Notch has a good reason to get involved in this.

If a software (including mods) is not licensed, no one, except the owner, has the right to share the product.
The Owner must be asked before. I posted this before on page 3 or so.
We don´t need to prove our identity.
Not sure if anyone else read their rules but the only one I can see that 'we' have broken by posting cease and desist threads is:
12. Advertising
One shall not advertise a website to gain anything for themselves or the website. One shall not advertise a competitor's forum, this includes but is not limited to linking to another forum or posting another forum's name. No referring people to such websites OR their hacks in ANY way.
However many of their users seem to be breaking their own rules... :/ Including:
6. No Warez
One shall not link or upload illegal material without permission from an Admin.
Or in other words the Admin by failing to remove the Mods, with this rule is basically saying that he/she is entirely responsible... :smile.gif:
I'm sure they didn't intend it to mean that...
Oh yeah and the whole legal thing:
Script Kiddies and Game Hackers may not fear the law, probably because they aren't clever enough to work their way through the implications. But as they say in their own rules failure to understand/know a rule does not mean it can't be used against you... That works just as well in the real world. :smile.gif:
Now where did I leave my BotNet... :wink.gif:
Don't bother, they have DDoS protection out the wazoo
I've discussed the issue with a few people and we agreed on this thread to become unlocked again, as it doesn't violate any rules by itself.
However, please refrain from using explicit swearing/flaming.
Thank you sir. About your previous post however, I do believe that if they took the mods from this site and posted them on theirs -even while giving credits- is still wrong, because no permission was given for them to do it. That's pretty much the same thing as copyright infringement, however the mod creators don't have an actual copyright on their mods.
Plus the fact that they IP banned the creators of the mods just asking if they could put their mods down is another reason why they don't deserve to put the mods up anyway.
They pretty much used peoples mods to gain reputation for their site.

the only thing we can doo is take legal action and let the mod owners know of this problem
Or order a cease & desist, as informing the modders has done nothing but get them IP banned. Theycould also contact the website's host, since gamekillers are violating their ToS with that host.

That's what Proloe has already done.

Mate, It doesn´t matter if you are making money with it.
You don´t have the right to post links to a download of a mod, which is copyrighted. Only and ONLY THEN:
With a written permission of the actual mod owner.
If the mod owner does not give a statement, you ARE NOT ALLOWED to post a download link. IT IS ILLEGAL!!
You are asking why?
Read:
Wkipedia says:
In most jurisdictions copyright arises upon fixation and does not need to be registered. Copyright owners have the exclusive statutory right to exercise control over copying and other exploitation of the works for a specific period of time.
and:
The copyright owner is given two sets of rights: an exclusive, positive right to copy and exploit the copyrighted work, or license others to do so, and a negative right to prevent anyone else from doing so without consent, with the possibility of legal remedies if they do.
Keep your focus on
or license others to do so
They have to give you the permission FIRST[/quote]
you are the only one here who is making sense and who is not a troll
This is a big deal, and the only way to end it once and for all, no wait there are a few more..
Anyways, if you do shut down Gamekiller through its host, try asking the host to spread info about this person so he/she will never have a host again..

Help me round up as much as possible, so I can make a strong case.
I would LOVE to help you, but I've been perma-IP banned from their site. Sorry. =/

COOKIE FOR YOU
That post was quite a while ago. A lot more people have been making sense. :/
Can they just find a new host for their website?

Might work?
