Actually, the word distribute is defined as giving shares of something; dealing out, or supplying stores, or companies with product/supplies.
The word shares is defined as a part of a larger amount that is divided among a larger amount of people.
So technically, as long as that person is to send the modded client to you, and only you, then yes, it is allowed. If he sends it to even 1 person other than you, it's breaking the T.O.S.
Legalities are far more in depth than just a simple no. It's never like that in law.

Well yes, the distribution of minecraft.jar is illegal, Mojang could right up and sue you for doing so. However, as I had explained in my past post, if you are to supply one person with 1 copy of it, it's not distribution.
Again, with these 'legal semantics'. I don't see that stated anywhere in the forum's T.O.S. Plus, it wouldn't even be doing anything ON the website. Discussion of legal activities would ensue, a file transfer would be put in action, and then confirmation of legal activities would continue after.
Do I support people sending out free minecraft.jars? No. Do I support proper justice being uplheld, according to the rules and conditions that people had agreed to? Damn right. And as such, people can trade one copy of minecraft.jar to one single person, one time, legally. Any more, and it's completely illegal. It's like a bong. You can have one, you can use one, you can give em to a dude who will use it illegaly. The important thing is, you can't actually use it in an illegal manner.
If it's insisted that minecraft.jars are truly not to be shared, or supplied to one or more persons, then that should be stated, rather than distributed. Until the T.O.S changes, which can be done at any point in time, without notice, it's currently legal. And that's what should be told.
Is it illegal to drink, or is it illegal to drink underage? You can't leave out the parts that actually define the law.
