I'm trying to figure out if CubeCraft's voting system violates the EULA once and for all. I'm posting it here because if I try to post it on their official forums, all the replies I'd get are heavily biased.
So, CubeCraft have these minigames that come in three gamemodes: basic, normal, and OP. Normal is the default mode, and the only way to access basic and OP is if a ranked (paid) player comes into the lobby votes for these gamemodes. If however, the ranked player does vote for a gamemode, it'll affect the entire lobby. Essentially, the only way to access basic and OP is if you have a rank or someone in the lobby has a rank and they are willing to vote.
On one hand, the only way to access certain gamemodes is if a ranked player comes in or if you are ranked yourself- as I've stated, but on the other hand, the ranked player's vote affects the entire lobby, so you technically don't need a rank to access basic or OP.
Now my question is: is this system against the EULA? Be sure to provide reasons.
The EULA only bans servers from selling things that give players an advantage over other players. This is why cosmetic items are fine, and this also means that since everyone in the lobby plays the gamemode, nobody has an advantage over another they can all play the same game so I highly doubt it is against the EULA.

Think groups. Separately, a ranked group and a normal group, now what do they have? The normal group has one gamemode. The ranked group has three.
Couldn't be more obvious.
The question is what to do in order to join the ranked group.

Now this seems normal to many, because the people who have Ranks must be able to have access to some things that Non-ranks can't...
But the problem here is that the Ranked people can decide for the Non-ranked as well! Basically they decide how they like to play, and the others should just roll with it, weather they like it or not.

Umm... why must ranked players have better access? If ranks are premium-only then that is a direct violation, if the advantages are not purely visual.
There's a very easy way too see if they're violating the EULA or not; report them to Mojang. They can check the system themselves, and if anyone knows what violates the EULA or not, it's the people who made and enforce it.
Are you sure it is a good idea though? It says to only report if you are sure that the server is violating the EULA.

I would say gamemodes are content. And obviousy more content = advantage

- Non-Ranked : Can only play one gamemode
- Ranked : Can play three gamemodes
