i cant understand whats wrong with bethesda i used to respect them for their art now im embarrassed for them. anytime someone refuses a peaceful resolution it shows them to be a bully and an egomaniac.
Well, it's unfortunate that the case has to go to court, but there are still valid reasons why they might need to. I guess we'll find out if Bethesda is protecting its IP, or simply being a corporate troll soon enough. I'll be holding off on my Skyrim purchase until I find out.
Also, while needing to protect their trademark is pertinent, the fact Bethesda Game Studios and Bethesda Softworks are considered separate entities is irrelevant. One of them pays the bills, while the other makes sure the former can continue to provide that cash. So, despite the separate names, they are still one establishment, if not one company. It's like saying "Sony Entertainment" isn't "Sony" because they have different names. By boycotting Skyrim, (which I don't see as necessary at the moment) you're effectively draining money from both companies, not just the game makers.
It would make my day if Notch came on here and said, "Hey everybody, feel free to flame full-force at bethesda." I mean, how can you turn down an offer of a friendly competition to resolve an issue? Who's ever going to respect them now?

I wonder what the people with the last name of scrolls thinks about this? Seeing how they are claiming the rights to the word XD. its kind of stupid if you ask me and looking at it in a business perspective, it is the wrong way to go and could potential lose them a lot of money. I guess the dictionary, all books, the bible and every other place that has that word in it will have to extract it from its content if they win lmao. That is like me claiming the ownership of air and suing every human on earth for stealing it. Also if you really want to look at it. They will soon try and sue us for using the word scrolls ops i mean no i mean scrolls lol. Its plan stupid to do this over a small term that is used millions of times each day. My college uses the term scrolls for programs students create, so i guess Bethesda you will have to sue my college as well as all the users on these forums. btw did i mentions scrolls? XD
Well, I'm very disappointed with Bethesda, I really like their games, but this just isn't right. They're really flexing their heartless law swinging competition crushing flail around and it's in my opinion disgracing their own brand as a game company to more of a leach (like the guy that sued McDonalds for getting fat). Boycott their products!

no bethesda(more accurately the development team) is actually quite smart look at what they made.... fallout, oblivion, morrowind, skyrim(i know its not out yet but it will be in a month and a few days give or take)
and all those games were made from a bunch of people typing up(and drawing, all the processess in making a game i dont know all of them) making games hoping that people will like it and they can get more money and make another game......
the main issue with this is the fact that bethesda is trying to lay claim to a single word, in this case "scrolls"
The way the court will probably see it is, Bethesda copyrighted "Elder Scrolls", which is the name of their franchise, they didnt copyright "Scrolls" however.
The same thing could have been done with Dungeons, the remake of Dungeon Keeper, but im sure the court wouldnt of heard that either, or the Dungeons and Dragons sueing Dungeons, or Dungeon Keeper, for simply having similar names.
if i recall, daggerfall isnt bethesdas. its a very old game, that most certainly predates bethesda. i cant remember correctly, but if i had to guess, it would be interplays game, since thats where bethesda originated from.
you would think that the entire Elder Scrolls series would have been shipped over to Black Isle (also spun off of interplay), since thats more down their lane than it was bethesdas.
They might have been able to get the names though, its hard to tell, since alot of copyrights were lost when interplay died out completely.
