Then, explain the case they could make using these factors:
1. Strength of the mark
2. Proximity of the goods
3. Similarity of the marks
4. Evidence of actual confusion
5. Marketing channels used
6. Type of goods and the degree of care likely to be exercised by the purchaser
7. Defendant's intent in selecting the mark
8. Likelihood of expansion of the product lines

not to mention they actually make a lot more money with one game Bethesda is quite a big name Company compared to Mojang but even so the reason they sue it stupid but i guess people do a lot for getting their money
It was a stupid move to attack a game with 3 million paying players and many more who play free (classic). And it's not just the people on the forums, there are people that look at the forum news that are guests and people who are informed by their friends. Now they have lost at least a thousand players according to the comments preceding this one and quite a bit of popularity. If they call it off now before it goes to court they might save some face.
I really can't see how this would turn out good for Bethesda. If the court case wins, thousands more might quit their games and they would lose a ton of respect, and if they lose, they lose money, a few players, and respect.
What the heck?
They didn't make up the word "Scrolls", so Mojang should be able to use it. It's like Microsoft makes a new Halo Game, then sues Sony or Nintendo for using the word Halo in a game.
This makes absolutely NO SENSE to me. Thank god that I already hate Bethesda anyway.
Plus, "The Elder Scrolls" is a SERIES, not a singular game. Plus it's an item in Oblivion, so really, what's to get all huffy about?
Or should I say...nah I won't.
Anyway I hope this get's sorted out soon-I do NOT want Mojang to lose this. If Bethesda loses it, that's fine, they still can produce games, but if Mojang loses...well...let's say that we might not be seeing updates as often...
Guys, this is a very understandable lawsuit if you know the first thing about legal practices. Everyone knows that Mojang would win if this went to court, including Bethesda and their lawyers. However, unlike a big company like Bethesda, Mojang probably doesn't have a copyright lawyer on their payroll full time, and it would be a big expense for them to go to court over this, therefore Mojang will most likely change the name to avoid having to fight for it. Until the day comes that Mojang hires a copyright lawyer full time, they'll most likely be picked on by big companies solely because they're an easy target.
wow... scroll is a word that is already exsisting. not something elder scrolls invented... they will only bring shame to themselves if they sue mojang.
their doing anything just to get money from other people.

Not the first time an indie company's been surd for using a word. If it gets renamed to "Scroll's Edge," then hilarity will ensue if Bethesda lets this drop.

Bethesda could "call off" their lawyers. They have control over their lawyers, and the head of the company could tell them to stop with the lawsuit.

i can only imagine they are just for the money on that otherwise they are wasting time....
IT DOESN'T MATTER. It'll still reflect on both entities badly.
