Yet, I never said, nor thought "the elder scrolls" when I discussed/ pondered those games.
It's not as if anyone ever said "I'm a huge fan of the elder scrolls" and got laid anytime soon after, amirite?
Well, since the game doesn't sound anything at all like the elder scrolls series, they really can't sue for use of the word scrolls. I mean, it's not infringing any sort of copyright at all as far as i'm concerned. Could you imagine if game companies sued everyone for using a word that has any sort of remote resemblance to one of their titles? New games would never happen because the titles would all be used up.

You are completely misguided. Those are product lines and phrases that are already registered, so therefore starting up a company with those EXACT names is impossible. However, that doesn't mean the word "apple" itself is something owned by Apple. It's not like a farmer is being sued when he is in fact offering to sell someone an APPLE. Or for that matter, neither are other companies around the globe sued for having "Apple" in their name. Even if they would get sued, that would lead to nothing, considering ONE CAN'T OWN A WORD.

Just to give you a very casual example, imagine if those pathetic developers of that pathetic game call of duty sue Call of Juarez because it has "Call of" in common and makes them too similar?
