No one person owns any word. What makes bethesda think they own the word scrolls. Even if they do have a point, the game is in development and can change at any time. Why sue?
Before people start to make anti-bethesda threads, I might just remind you that its bethesda's lawyers are suing mojang, not bethesda themselves, they're just being stupid. with that said, I really like bethesda and can't wait for skyrim!
As it was stated earlier, companies legal departments cannot file lawsuits against other companies without the companies permission. To so so would be to break the law themselves.
Try trademark Scrolls and maybe you will get sued. lrn2trademark. Just like if you have a product that starts with a lower case i you will get sued by Apple.
Also, they have the SAME RELEASE DATE. Theres a larger chance that people will confuse the games, in fact it almost seems planned on Mojang's part, the releases can negatively affect the sales of Zenimax's game. (Not Bethesda, Zenimax)
I'm not sure what your talking about here. Minecraft is oficially releasing on the 11 of november, not the 'Scrolls game this thread is about. It is unrelated to the issue at hand, but I will have to agree with a few of the other points you made though.
To the guy asking for games starting with the word "Scroll" go to a trademark database and search for the word scroll.
I mean truly own the word, not legally. Legally, people owned other people (slaves) a few centuries ago but that did not mean that they truly owned the people.

Dont speak for everyone. I know a shyt load of people that love there games. Infact they have 3-4 games that have Game of the year.
