Let me re-post my earlier post for the next thirty 14 year olds about to say "scrolls! omg lol sue me Bethesda"
Let's not jump to conclusions. Bethesda is NOT suing Mojang. Zenimax, the company that owns Bethesda, is suing Mojang. It's possible that Bethesda itself does not agree with this, but you can't argue with the boss. It's like, Viacom suing someone for using the word Pimp in the show. MTV would have no say in that. Stop saying, screw Bethesda, it wont help.
Once again, it's not Bethesda. It's not even Bethesda's lawyers. It's Zenimax's lawyers. Bethesda has about as much influence on them as you do.
Second, despite the beliefs of most on this thread, you can, in legal terms own a word. That's what trademarking is for, and often the suing party does win a case like this. If they can convince the court that this can confuse people in the market, and lead to lost profits, they have a chance of winning. However, It's probably as Notch said, "Lawyers being lawyers".
Lets clarify this. You CAN own a word or phrase if you trademark it and it becomes industry standard. If that word or phrase is used in the same industry, or in a setting where it can be confused with the original trademark, there are good grounds for a lawsuit. If someone asked you about a game with the word "Scrolls" in it, who would you have said, before Mojang came out with theirs? Thats the confusion.
Also, they have the SAME RELEASE DATE. Theres a larger chance that people will confuse the games, in fact it almost seems planned on Mojang's part, the releases can negatively affect the sales of Zenimax's game. (Not Bethesda, Zenimax)
In a free market however, you do have the right to boycott their games, and this is where indie companies have the edge. With the closely knit community, you can organise something like this. I'm sure our friends over at unnamed sites could help, those that play MC, or spreading the word not to buy Skyrim until they withdraw their lawsuit. Things like this help, not "screw Bethesda i hate them loloololol"
Because, Mojang is threading a thin line here and its not going to benefit anyone.

Also I agree with Dark_Surf, nobody owns a word unless they create it and it still is technically not owned by them because words are used among this Earth, that is fail how they would do, they are just trying to cash the very unfair way and I Know they are smarter than some one like me who is under the age of 18!
