Same applies here. If a large group of people were on the fence on deciding whether or not to purchase MC, and notch says "It's official, <insert feature> will be included in the final release" so you decide to buy the game. Then you receive another notification saying "Just kidding, fooled you" (but in more rational terms), then the group has a valid case for fraud.
All of this assuming the game is no longer in beta.

Well the thing is, anyone rich enough to find a lawyer good enough to win such a weak case wouldn't be suing. Infact you almost virtually have no case, I don't think any lawyer could win that case.

Yes anything is possible, any case can go either way, because you could have all the evidence against someone but the jury/judge, depending on the case, could just say innocent. However normal people of the jury aren't retarded. Usually when this happens it is racism.

That's the thing tho, there is no test for the intellectual capacity of the jury. Some of them are very nearly "retarded" as you say.
Yes i do, if you are mentally able and no obvious hindering aspects are present, then the only way to not be in the jury is unfair objectivity (or if you have previous crimes on record). That means that people that are literally mentally handicapped can (and have been) accepted to be presented as a member of the jury.
Ergo, people can be "retarded" enough (as you say) to make a bad decision, ergo, anything is possible, which is my only point.
