So many posters are ignorant of reality. Every time a player logs into your Minecraft server, you are using the Mojang login servers. In order to do that you have to agree to their rules. Here is what I see happening next:
1. Soon you will need to tie you SERVER instance to a valid Mojang account.
2. If you do not follow their EULA, your account will be banned and no one will be able to log into your server
Pull your heads out of your asses. If you are running a Minecraft server, you are using a licensed product owned by Mojang. Either learn to play by the rules or prepare to banned.
I for one hope they start signing all their java classes and enforcing those signatures when communicating with the login server. That will everyone will know that some jackass has not added Trojan code to their plugins.
Even Hypixel himself said it. Look all over the Hypixel forums.
I've had people steal my work and other artists' and claim it as their own.
That doesn't mean that they really have any legal right to it, just because they claim say they do.

Learn this now: nothing in life is free. You are not entitled to a free loaf of bread (irl), let alone playing on online Minecraft servers hosted by people out of their pocket and own good will.

First off, it isn't out of their pocket. This entire EULA is about how it is illegal to take money from these people for "donations" and reward them with perks. Also, this is on their own good will? They want money, it is as simple as that. Hypixel is probably making bank off of this and other large servers are probably shoving loads into their pockets, they are upset because they are losing their "jobs". If I am giving "donations" to a server, I would like it to go to the server, not to providing them wellfare. And yes, nothing is free in life, that is why he, or someone else, paid for his Minecraft account so he could play. We should not be burdened by other illegal fees described in the EULA. If you want to make a Minecraft server, you better have the money and support come from you, THAT is good will my friend.

Oh, so it is true. Wow, that's really messed up. Everyone or nobody they say, yet they do this and try to hide it.
Yup, Mojang definitely kisses the butts of favors certain players (IE: youtubers, map makers, server owners and a few mod makers). They also deny doing it.
If this stuff isn't fixed, I may go ahead and start a simple sandbox voxel game similar to Minecraft, but with cooler stuff, maybe more realism and ALL for the community.

So tell me, how do Mojang know the servers are running their code?
I have personally experimented on clean-room, C++ Minecraft servers, Mojang have no way to guarantee that servers are actually running their code.
Again, that is another model that is core to the development of internet technologies (And it's an older model from the 50s)
If they can guarantee the server is running their code, then Mojang can do what they want, but they can't possibly make the guarantee. EULAs do not apply to those who never accepted them to begin with, so someone who doesn't even own Minecraft and has never downloaded the server binary can potentially write their own server that is compatible with the MC network protocol and then put whatever rules they want to on that server.
Cool, then your 'clean-room' users just need a cleanroom version of the client that doen't use the Mojang login servers and you are set.
As long as you are authenticating your users via their Mojang accounts, you are subject to Mojang's rules.

Why would you pay for nothing when other servers provide you with something for money? This is different because there will be no servers allowed to sell power. You either donate to keep your favorite server alive or quit multiplayer MC altogether. If Mojang expands customization options like custom block skins, I'm sure people would be willing to spend money on servers. They could even make it so only paying customers can see their custom skins while the rest have the default skin. This have 0 gameplay effects but I'm sure people will spend some cash just to show everyone their cool skin.
Guys, this is just to try and force players to use realms by destroying the server community. We need to stop this by organizing a boycott against Mojang so that they have to relent before they lose money (and we still get 10 years of development first!)

i simply point out that not everyone in this world can pay via the same methods as you.
i have money, but i cannot convert it into an online acceptable method.
and while i do not expect *every* server to go pay to access, i DO expect all the types of server i prefer to play on, to ether fold faster than superman on laundry day, or to have to ask its users to pay for the use of their server. becasue not everyone wants to play on a server that allows players to set fire to your build. or fill your garden with TnT. or slit your characters throat while you take a bio.
i personaly, like to play on no-pvp servers, and those are actualy few and far between, becasue apparently its more fun to murder people and grief their stuff. (whether you pay extra to do it or not)

They own the core server software. As long as you are running it, you are agreeing to their rules. Don't want there rules? Write your own server completely from scratch and provide your own login servers. Ever if ALL the code on your server was written by you, you cannot use the Mojang login servers without having some form of legal agreement with Mojang.

What rock are you living under? They don't need to justify anything. If you are using their code (ANY OF IT) and you authenticated your users against their login servers, you have to play by there rules.

The EULA give you plenty of ways to charge your users for the resources they use. Heck, you can even copy Realms model and just charge all users to login. This will not push anyone to Realms as servers still have tons of ways to provide services above and beyond the simple no-frills model that Realms is following.

No, because this will only shut down a those servers that are not willing to be creative in what services they are selling.
They are not preventing you from selling access to your server, they are just trying to make sure that all players have access to the same "base Minecraft experience".
