This new "improvement" is completely and utterly nonsensical for a number of reasons.
1. People are greedy, even though some people donate to servers out of the good of their hearts, most people don't, in game advantages (to a reasonable degree) provide people a reason to donate, as without this, servers would lose a lot of their support, and for big servers this would prove fatal.
2. Mojang has just recently (within the last year) started their whole thing with Minecraft realms, and before that all of their various Minecraft ports, which in themselves are fine, but given the situation, smells of a money grab. Mojang is wallowing in their success, and as such, as developed a certain stroke of greed. How does this relate to the topic at hand? some of you might ask, well, the answer to that is quite simple, if the big servers lose their support due to lack of donations (that would not have been obtained without given incentives), these servers will die, more people will use Minecraft realms, and Mojang makes more money.
3. There is absolutely no logical reason behind the "we just want to protect our player-base" claim that Mojang has used to justify this, if a server blatantly abuses the incentive system, such as allowing doners to abuse other players etc. etc., then that server will die anyways, and if it doesn't, then quite frankly either the support base of such a server is clearly inept or the owner is more then happy to pour tons of money into the costs of a big server, and thus, the problem lies with them.
4. In general it never turns out well when a company seeks to regain control over a community; Minecraft has been fine as it was for the past few years. make your own decisions people! don't support some company in its crusade to make them for you.
Okay, if Mojang really wanted to not have donation perks they should have cracked down instantly, instead of ruining many server owners that already established things based on donation. Does Mojang have good enough lawyers to take down the servers anyways?

They had good enough lawyers to fight Bethesda/Zenimax to a draw on the whole Scrolls issue, so I doubt they'd have much trouble with server hosts.
I'm no lawyer but I'm sure that has legal issues taped all over it *shrugs*
It really doesn't, if you run the software then you accept the EULA for that software, the EULA for Minecraft should not extend to Windows, Photoshop, Google Chrome, Quake Server, SrcDS, My_Crafty_Clone_Server.exe or any other software and Mojang simply can't make this guarantee without looking at the private machine's software.
I learnt all about EULAs after dealing with the RPG Maker community, where RPG Maker has an interesting EULA that goes sketchy with the usage of their art assets (Their art assets are only allowed to be used with the RPG Maker software, however Enterbrain can give permission for assets to be used outside of RPG Maker and there are several dodgy cases such as custom clean-room executables) and I was in a community that had legal support donated to it to sort out the EULA mess with Enterbrain directly for clarification.
As a result of all this, clean-room RPG Maker clones are fully okay and avoid the EULA but the RPG Maker software must be involved when the RTP resources come into question, I actually think Enterbrain are revising this now that they're on Steam, but that's a whole different company and story and I'm going off topic here XD

The only way I can think of stopping servers like this is to talk to hosting companies and stop their services, but they would lose all their money.

Actually the court systems can compel the hosts to take down the servers for violation of copyright laws. I don't know if Mojang would go to that extent though, it's more likely that the server hosts would cooperate with them. The vast majority of servers should be unaffected by this. It's the big servers that will probably be widely impacted.
Who in their right mind will pay to play a server before they even tried it out? Minecraft is turning into Steam but every game is the same just with small differences. I respect Mojang as server owners have been infringing on this but to be honest, they're going to put people out of jobs and stuff. It's disgraceful in my opinion but it's right. Urgh I'm so annoyed.

I'm curious how much profit they actually make off of realms servers. I don't doubt they'll make money off of them, but I seriously doubt this is some sort of money grab on their part. Seems like they are just tired of getting complaints from people regarding some of these ridiculous "Pay for the golden magic sword of awesomeness" stuff that's going on with some servers. Most servers are probably being reasonable with pay items, but as it goes with most things, the bad actions of a few ruins things for the group as a whole.

I thought this to be very possible. But there is no evidence, however I can see Mojang trying this. Expecially since purchases for Minecraft are lowering, they're making less money, so Realms might've been their solution.
I actually thought about it and maybe this is good we have too many clone server guidelines like these will make people think harder and be more unique as to how the server may survive no more clone servers will be this result

But if it doesn't, then this could end a lot of things.
Also I could see making a "ghost mode" that allows unpaid people to walk around in any open area of a server but not interact with anything, pick up items on the ground, or to be seen by anyone, or to speak in global chat (but can see it), and they can ask questions of mods/admins about the server.
Actual access beyond a read-only view of the world requires payment.
That's already in the incoming versions, called "spectator mode".

I did some CraftTweaker scripts for Mystical Agriculture. They fill in a couple of small gaps in MA, and also let you make or duplicate not only vanilla plants, but the blocks, plants and wood from Quark and Biomes O'Plenty. Also spawn eggs for most vanilla mobs! The scripts are here on Github.
