Because Mojang owns minecraft, it would break copyright laws to make money off of somebody's Intellectual Property.
Like I could write "Harry Potter and the Magical Dildo" without breaking any laws as long as I don't charge anyone to read it, as soon as I make a penny it's illegal.
Suffice it to say that your understanding of Intellectual Property law in the US and on a global scale is completely inaccurate. It's too complex to go into here, but I suggest you do some serious reading up on it before you write your book. A copyright violation is still a violation even if you don't make a penny on it. There are multiples 'test" that define "Fair Use" in US legislation and many countries around the world do not utilize the "fair use" principle in their copyright laws at all. Trademark violations might also enter into it and fall under different legislation. International treaties can also be involved.
You go from clay soldiers to economical reasoning, **** we have some slight crazies in here. SARCASM if you can not tell!!

No, they looked pretty cool on the mod showcase I saw but not worth the time or money for me. Now maybe if they had larger scale stuff for it, like mini battles or clay soldier castle sieges, I would pay for some of those mini games with them.

Well, I suppose I could have put it more simply - He can write his book, put it online for absolutely nothing, and J. K. Rowling might still sue is A**.

HAH in laymen's terms, your life will be f****d.
Understanding to the fullest.
Just joking around though, never take me seriously, that is probably the case for 80% of the folks on this damn forum...
Your poll is messed up- there's no "0" cost option.
No, I don't want it, there will be no "PC" mods (only original xbox mods) so the question is pointless, and since I don't want it even if it were free, I wouldn't pay anything for it.

Why wouldn't you pay?(please dont say because its free on PC.)
There are no "legal" reasons why they couldn't make it because all modders do is mess with Mojang and 4j's code they don't have a leg to stand on.
Are you sure about that. You probably right about the code but the idea is what they could fight over its called intellectual property. And if Microsoft was to profit from someone else's idea that they(original mod creator) also implemented in a game with the consent of the game maker(mojang). So Microsoft wont take that chance nor will 4J so they will not be doing 1to1 copies of mods for that simple reason. Which they have already announce that's why its pointless to have these threads 4J said its not gonna happen plus they don't need all these polls to tell whats popular and what would work on the Xbox as DLC.
fist off any mods not place in by the creators of minecraft with Microsoft's permission is against the rules of xbox so most mods will never be able to be on xbox

Can give me a link where 4j said that?

"The struggle of survival is a war without end, and war – war never changes." -Ron Perlman in Fallout.
I could dig up a few links to articles where 4J said they would not be bringing pc mods to the 360. But instead use them as inspiration to make there own. But I wont because I'm to lazy to do so. Why dont you research it yourself. They really did say that or something very similar..

Also if the intelectual thing was true then why isn't the world in a monopoly(i.e.Coca-cola and Pepsi,Nitendo and all other consoles.)

Because the sort of game play having clay soldiers for just doesn't interest me and I stated it because the pollster asked the question and I really should have stayed on topic in the first place. My bad for entering the thread. I just don't like it when people spout off erroneous information about IP rights. One reason I bought Minecraft and not one of its clones, is that 4J has Mojang's permission to port the game to XBox.

I added that, and apologize for not making that clear

Go do some research please.
