Yes, you can play local splitscreen multiplayer offline without any XBox Live membership signed in as long as the game itself is being played on the console on which it was purchased. An XBox Gold member may also sign in at least one guest profile online if that guest is playing splitscreen on the same XBox as the Gold member.
You need XBOX live gold and you need a friend to invite you. If you mean split-screen then idk, im trying to find that out.

Online splitscreen requires at least 1 gold membership and that player has to be signed in as the first player. I know that 1 guest of the gold member can also play online splitscreen without being a Live member. I'm not sure whether 1 gold member can have 3 guest nonmembers playing splitscreen online... never tried that one.
Recently lost my gold membership, and I'm trying to play split-screen offline but for whatever reason it's not working. I created two new offline accounts for my brother and I (because our other accounts are very annoying to log into now that we don't have gold), and for whatever reason it won't let us do split screen. I'll log us both in and start up a world and whenever I try to get the 2nd controller to engage in split screen, it wont work. I've checked the settings and split-screen multiplayer is enabled but whenever I press the start button on controller 2, nothing happens. Any ideas?

Did you recently unhook your 360 and re-set it up again? You have to be using an HD cable in order to support split screen. That is the only reason I can think of why it wouldn't be working.

Minecraft does not allow guest players. I've already tried it with my fiance and it only gives us the option to sign her in with her profile (which doesn't have gold), create a new profile, or download a new profile. There is no option to sign in as a guest.

I haven't had an opportunity to try it since TU15, but I have personally used the Guest player option several times before that (with one other guest player, just not 3)... so unless they changed something very recently, the option is there. If you're playing in a world you are hosting, just make sure that you have the world loaded with "online game" checked before you start up the second controller. The option to sign them in as a guest should appear when they hit "start" to join in since they are not signed into the console as anyone at that point. If you're trying to sign a guest into another person's world rather than your own, they may have restrictions set that prohibit it. I believe they must have the "Allow Friends of Friends" option checked.
Yes, you need to be an Xbox Live Gold Member to play online. Silver (free) members cannot play online on anything.
