I have a scoreboard that finds and "Marks" a special item using a useless attribute modifier. However when I run the command to find said item it fails to "Mark" it. Code for scoreboard, the "Mark" code, and the items summon code are below. As always any help is appreciated and thank you in advance.

I think the problem is you're trying to give an item a horses attribute, my suggestion would be to get rid of the attribute stuff and use something like the lore:
/summon Item ~ ~-1 ~ {Item:{Count:1,Damage:8206,id:minecraft:potion,tag:{CustomPotionEffects:[{Id:11,Amplifier:2,Duration:2400},{Id:12,Amplifier:2,Duration:2400},{Id:13,Amplifier:2,Duration:2400},{Id:9,Amplifier:1,Duration:300}],display:{Name:"Ale",Lore:["Become as tough as","a Drunk Can Be"]}}
/scoreboard players set @e[type=Item] Mark 1 {Name:"Ale",Lore:["Become as tough as","a Drunk Can Be"]}
If that doesn't work then tell me, I haven't tested it myself.

Thank you for the tip however, this doesn't fix my problem for multiple reasons. First off,even though this would work, it would not allow me to test for multiple items where as testing for a attribute modifier does. Second off, the attribute modifier itself doesn't need to work as long as it is a valid NBT tag I can trace using the scoreboards ability to look at a mobs NBT tag. Finally, the Attribute modifier itself does work on items, however you can not see its effects unless it is put on a saddle. Thank you though for taking a stab at the problem
