I play on a server where you have to pay 15$ every month to play.
Someone on that server usually perform exploits that render the server laggy and unresponsive. The owner has been rapidly banning him and his IP but he always gets an alternative account and uses different wifis (he claims to go to different coffee shops) to keep causing trouble.
Since he is making people feel bad about spending 15$ to play on a laggy server, can he be dragged to court by the server owner or even any players who play on the server?
I just ask to know. It's highly unlikely that I nor the server owner would charge him.
IMO, if he has to pay 15 dollars to join every time, the only person who's gonna feel bad is him, but I digress. As for how legal it is, I don't believe there's anything illegal being done here, so no, I doubt he could be charged. However he COULD maybe be sued, but I'm no legal expert, so I wouldn't know for certain.
If there isn't an SLA (Service Level Agreement) or otherwise terms promising players a minimal measurable "play ability" then there nothing you can do about your money but to cut your losses and join a new server.
Now IF there a agreement that said something like this...
"This server is promised to be operational at no less than 18TPS in a month 95% of the time and having an uptime no less than 99%"
Or what not then a class action lawasuit could be done against the owner for not following the SLA/agreement.

Insanely right? You can get a SOLID 2GB shared server on that note. Unless the server was HIGHLY customized or something the most I would ever charge a single person would be $5/month. Even then it pushing it.
Boy, leave that server. 15 dollars? Seriously? Unless someone is hosting it for your group of friends, you are getting scammed. And unless your server has promised a non laggy experience(as stated above) there's only so much you can do.

It still the owner responsibility to deliver the product (the "slot" as advertised). Meaning they got to do what they need to do to retain within the contract (in this case the quotation) even if that means banning the one causing the product to be "defective" or even ponying up for a server upgrade.

I believe that paying $$ to play a minecraft server is against EULA. Not really sure tho. And also the owner should add Terms And Agreement(whatever its called lol) stating that laging the server could result in bans or such. Also. RIP that guy who makes the server lag. Costs $15 for him to do that + about $22 for minecraft account.
