Hypixel isn't violating the EULA either. They sell pets (they only exist in the lobby and they do nothing), fireworks, colored name, particles, et cetera. Everything is cosmetic, no gameplay changing stuff.
They're doing this since the EULA was enforced (1 year ago) and it seems like they're the same as before with more servers and new games.
You can pay the costs of the server with the new EULA, you just have to be smart and think on new cool stuff that does not affect gameplay. (For example, on Mineplex, you can morph into mobs in the lobby. That's cosmetic, does not affect anything at all, and it's pretty cool)
A player can build a diamond set of tools by mining, OR can donate and as a perk recieve the tools. Thats in line with the EULA,
HOWEVER, a server owner somehow blocks access to diamond tools, and the only way you can get them is by donating, that breaches the EULA.

The EULA was created to prevent players from receiving unfair advantages, based on how much they donating. The ability to buy specific items provides an unfair advantage, regardless of whether or not the item is obtainable. It is not against the EULA to restrict access to an item, doing this does not make a difference. It is the actual selling of the item that is being prevented. The EULA was intended to stop both of the cases you mentioned.
The EULA only applies to unmodded vanilla Minecraft, which means that a survival server would have to follow the EULA but a minigame server would not. That was my understanding, correct me if I'm wrong.
I am not sure how you would have gotten this impression. When you attempt to launch a Minecraft server, that includes the base Minecraft code, you are forced to agree the EULA again. The conditions of this EULA would also apply to any derivatives that don't force you to sign their EULA. There may be some gray area with server software like GlowStone, however the client is also bound by the EULA.

You are likely referring to Mojang's blog post about their interpretation of the EULA, and their list of things they don't want players to do, such as selling or giving away capes to other players. These terms are not part of the EULA, and are not legally enforceable.

As far as Mineplex goes, it's not violating anything. Yes, you can buy in-game currency with real money, but the in-game currency is used to buy cosmetic items.

It is definitely possible to get donations even not selling game-changing items/perks. I mean sure it will be harder in the beginning and you might have to start out paying from your own pocket but if you're not ready to do that, you probably shouldn't have a server in the first place.
I see a minecraft server as an investment. To begin with, you put a lot of money and effort into it. Once you reach a certain point tho (and of course you should have a unique idea for a server such as mineplex) then everything will work out and the server will be paid for by the community. People who enjoy your server and have the means to donate will donate. Forcing people to donate just so that they can have fun is a terrible thing (and selfish) and if you're against EULA, you are essentially promoting an unfair, profit first server which not a lot of people want to be part of. (no wonder those servers don't get enough donations to begin with)
Is it harder to get donations? Maybe by a small percentage. But that just means you need to think outside the box and offer packages that are fair. Be creative and offer your players a good time on your server and donations will come.

What counts as a server? Are proxies one big server, or lots of smaller ones?
A server is something a user connects to with their client. The user is on a different server when they leave one and manually join another (in the multiplayer screen). Virtual servers and proxies make no difference; to the client it’s the same server.
Can I charge access to a specific part of my server, such as a minigame or world?
No, you cannot charge for any part of a server. Only the access. Once on a server, all players must have the same gameplay privileges. You may make a different server which features “premium” areas, and charge for access to that server instead, but the benefits cannot carry between servers.
I think linking the servers with bungeecord is allowed but then again i could be wrong. All good as long as perks don't go from one server to another as far as i understand

if a server sell pay to win items through donations isn't violating the EULA since it can't be proven that is selling items because officially the server is rewarding the players that donate real life money to keep the server open. this is a legal loop
This thread has grow very long and I would like to thank you for posting on this thread and help me better understand.
Though this brings me to the topic of what if servers do get caught violating the EULA then what will happen I know for sure that the server might be terminated but what else could happen? Because when I see most pvp servers like faction servers they still offer Pay2win options will these servers be terminated?

The EULA bans both P2W and Pay to grind less.
