Hey guys I just wanted to talk about the Eula it's been about 1 year since the new Eula came out but yet mojang has yet to punish or shut down the servers that are violating Eula. So what I want to know is are they going to actually do something about the servers violating the Eula like mineplex or if this is just one big troll tell me what you think.(I think this is the wrong place to put this in tell me where I should put it)
Actually, Mineplex isn't violating Mojang's EULA. Mojang is trying to eliminate the "pay to win" aspect of some servers, and Mineplex is rewarding players who donate by giving more more hub game items and allowing you to instantly join into servers rather than exclusive kits or something. Anyways...
I don't think Mojang will do anything, because that's not who they are, but that doesn't mean you should violate it for your server.
The problem is, servers cost money, and people aren't just going to donate because they want to. They are going to donate because they get stuff in return. If Mojang starts enforcing this, a lot of servers will shut down.

Personally I'm of the mindset that if the only way you can run a server is to give pay to win items then you probably shouldn't run a server. Might sound harsh, but if the eula was actually enforced it would improve the multiplayer community as a whole.
A case could be made that Mineplex's 3 second chat delay that you have to pay to remove is against the eula.
The EULA only applies to unmodded vanilla Minecraft, which means that a survival server would have to follow the EULA but a minigame server would not. That was my understanding, correct me if I'm wrong.
Rollback Post to RevisionRollBack
I bought and started playing Minecraft on March 22nd, 2012, during 1.2.3.
The Eula is made for all servers no matter what type it says you can't sell anything unless there cosmetics like color in your name or permission to use the /nickname command this is to eliminate the pay2win servers.
A player can build a diamond set of tools by mining, OR can donate and as a perk recieve the tools. Thats in line with the EULA,
HOWEVER, a server owner somehow blocks access to diamond tools, and the only way you can get them is by donating, that breaches the EULA.
More than happy to be corrected if I'm way off here!
No, the server can only accept donations or sell cosmetic stuff.
Lets say there is a server that changes the diamond generation making it really rare and they sell diamonds for 1 dollar. If you spend 100 dollars on the server, you will be really OP compared to someone that didn't bought anything. This would be a pay-to-win server, right?
Though if you think about it most servers will probably be shut down if they do Inforce it because really people are going to be like what's the point of getting these cosmetic items if they do nothing except give you extra flare which is not really worth $10.
For example someons buys a color for there name for like $2 even though it's cool not many people will care and servers might not have enough money to keep there servers running.

Mineplex isn't violating the EULA. It says that purchases can be made for cosmetic items and not affect gameplay.

I think that your thread should go here.
They actually are because they are selling in game currency for money.
I think its all good now a days
I think for the most part the whole EULA thing was a spook, I still see many pay to win items, then again it's been ages since I played SMP.

That currency is only used to buy cosmetic items I believe. Nothing bad because you can't use that currency to buy gameplay items.

Doesn't do anything to us. We've been a donate only server for years now.

They are still selling in game currency for cash.
Awesome post : )

So many small servers offer pay to win, its only the big servers who follow the EULA because they are afraid they might get noticed.

Yeah it is one of the reasons I don't bother with servers any longer.
But still the EULA says you cannot sell in game cash for real money no matter what it's for.
The EULA says you cannot sell "game changing" items with hard currency (cash, real money).
But you can have hard currency for cosmetic items/effects/whatever
