Mojang won't be doing anything. Its already been against their EULA for many years, and they did nothing. What makes you think they now their EULA is more server friendly they will be doing more? This is nothing more than a scare tactic and it seems to be working.
Mojang makes it seem they are NOT about the money, so I am going to pretend that is the case. Why would they spend boat loads of money for Cease and Desists and lawyer fee's, since they don't want a piece of the pie. Anything short of Mohjang forcing you to use a server from one of their partners or themselves, there isnt much they can do without forking over tons of money.
Why are some of these people still inanely arguing over this crap? Seriously, it's Mojang's game, and you the player accepted its terms when you purchased it. Stop trying to be a bunch of entitled little children, and actually try to understand the situation.
This thing about servers only being able to charge everyone or nobody at all makes perfect sense. If a server is honestly that amazing, then charging a small standard fee for everyone seems fair enough, so long as everyone gets the same experience. If the server is poor, then the player should be smart enough to not waste their money and let the server die off without funding.
Seriously, as the OP up there says, it outlines what can and can't be done according to the EULA that everyone that owns a copy of this game has accepted, period.
As for Marcus101RR over here putting up such a desperate and pathetic fight, even to the point of openly admitting that this document that he accepted means absolutely nothing.
Seriously, these are the terms that people have agreed to, and think that they're invincible to them and can just keep making profits off of a game that they put 0 work into. It's honestly sad, Mojang is trying their best to make a compromise to allow servers that need funding to stay alive to acquire it via donations (for aesthetic items essentially), universal small fees for each player, and even in-game sponsoring or advertising opportunities. They're doing all this because they know the community enjoys the servers they take part in, but they are still violating the rules, and are letting them off with essentially a warning at the moment.
But really, it is Mojang's game, and they can essentially do as they wish with it. I'm actually really shocked they haven't stopped updating it by the lack of maturity and fighting going on over such a topic. You guys agreed to the terms, you don't like it, nothing you can do about it.

If mojang are only targeting the huge servers where people make insane profits, they should clearly say so. Instead of going on a witch hunt after the entire community.
Legally they can't do this or it could undermine their efforts to go after those bigger targets. If they indicated that they were being selective, it wouldn't be hard for someone to sue them if they did get targeted by Mojang.

Of course Mojang is not gonna monitor every friggin server. Only servers that break the rules will be reported by the people that play on it. If all players playing on it are fine with it, it will probably go unnoticed and the rules will not be enforced.
Not sure how Mojang is gonna handle all the reports and enforce it. Thing is that they can make quite a lot of money off of your server if it breaks the rules and you get into a legal dispute, which they WILL win because you accepted their rules when you started up a server.
They have made the rules, and could as well say "no more independent servers, blanket ban for every server ever" and even disable minecraft multiplayer functionality except if Realms or something. Be happy that that didn't happen in the first place.
If you say "I don't give a rat's ass", ignore the rules, and have the bad luck that Mojang catches wind of it, runs a simple IP trace, reports it to local authorities who can investigate further, you can expect a heapload of legal trouble just for some extra few dollars/euros/whatever.
It's a "scare rule", it's likely impossible to enforce on a large scale, but the consequences of its enforcements should keep server owners on their toes and make them wonder if it's really worth it.
#1 Allowed to charge access to your server, but NOT various ranks is a horrible idea. So instead of allowing free players, and 6 tiers of donators with VERY MILD and non-game breaking perks to co-exist - we have to force people to 'pay or not play'. It means instead of a fair balance allowing players to choose if they wish to donate or not, we have to push it to a system where you pay or don't play, since we can't use a more moderate, fair method.

For a company that acts like it isnt about the money, No way they go that route. They might talk with the biggest of the biggest of servers, but that is it. Any server that is Med. and below they won't bother with. Its a waste of money, and all business's bottom line is money. Agreed, but why would we want everyone to pay a smaller amount overall to support the server they enjoy? That makes absolutely no sense, I'd rather pay larger sums of money for content that nobody has access to without payment so I can make everyone else feel bad and not follow the terms I agreed to!
But really, if a server is genuinely good, people should rise up and support it on their own, if not pay as a whole a small fee to keep it alive and well.
Well, actually it's pretty much better this way. As I said above, if a server is good, the players should be mature, appreciate the content provided for them, and support it as a whole on their own with donations. If not, then at least charge a minor fee for everyone. Also it isn't like you can't host a server on your own, whenever I want to play Minecraft with my friends, one of them just hosts it right on the computer they play the game on, and we all join in and enjoy.

This is an interesting subject, but, we all know minecraft games alike have done this many times. What will they do to enforce this rule? Shut down your server? Can they even find out who runs/owns it?
1. I have run a server under an alias with fake information before, and even on a private machine, which means they wouldn't be able to contact the host, because the host would be me, and the email would be unresponsive.
2. How I run a server, what ranks/tiers are payed for, or content I decide to run via plugins is non of their business...
Sounds to be like a fail by mojang to be honest. You cannot control how servers are being run...
I would love to see the reactions and discussions on this matter, this is sure to fail. I can't see anything bad happening if someone ignores these rules...

They would revoke your IP from the session servers as they said that they would, they obviously don't need the host's permission.

Some might do that, but not the same amount as the people that want to gain something for themselfs by donating.
Then in that case, then maybe that's not a community worth catering to then if they aren't willing to pay for a service worth paying for. That's like saying, no, I won't pay to see this movie, I want to see it for free, even though the producers worked very hard to make it and it costs them more as a whole than it would cost me. It's a very selfish thing to do, but that's just how people are, and it's just too damn bad people can't be bothered to do any sort of good for others, even if it's to pay for a server to enjoy themselves.

As the owner of a 3 year old server, I'd like to add my opinion.
Most large servers are expensive, and many depend on donations from the community to survive and continue running. I am confident that without donation incentives my server will still generate the needed income to pay the semi-annual bill. If the server is well run, people will donate out of kindness and their generosity will help to secure the future of the server.
I do feel that not letting server owners reward these acts of kindness may result in many of the servers that make up the fabric of our fabulous community being killed off. On my server, TNT use is restricted to donors only, as by donating they have proven their support to the server, and there is a much smaller number of donators than regular players. We offer TNT for donors as a security measure, to keep the server playable and enjoyable for all our players. It worries me that in this instance, either removing TNT entirely or allowing it for everyone will be the only way forward - both options are not ideal.
Hosting a server is a hobby of mine, I have a full time job, children, the full works. I rely on donations to keep the server running. I feel that removing the ability the server owners to "give back to the donors", however big or small it may be, is catastrophic. I feel Mojang is trying hard to increase the popularity of their own branded "Realms" servers. To do this, their only option is to restrict and govern servers that aren't theirs, in way which is harmful to the health of the community.
You will squeeze the life out of many servers and eventually lead to closures. Can you not see that?
They clearly said donations are okay, and that it is okay to reward for donations, but not in terms of in-game items that affect gameplay. So this shouldn't affect you at all, unless you are one of those servers that rewards donations with special in-game stuff that actually affects gameplay. Personally I couldn't care less if they enforce this or not, as I do not play on servers typically (I usually play SP or MP on a closed server with friends) but I certainly would never consider playing on a server that had the equivalent of IAP for gameplay affecting items so I think this is an appropriate action by Mojang. You have the right to get money to help support a server but running the server shouldn't be a mega money making enterprise, especially for something you had no hand in actually creating.
Stop for a second and ask what would happen to Free To Play games if suddenly they were forced to be depended on donations alone? Do you think they would be around for long?
The world would be a better damn place without F2P games to be quite honest. 99% of them are ****ty money grabs. Yeah, there are a few great ones out there, like DOTA2, LoL, etc. But for every great F2P game, there are like 10,000 crappy Facebook game knockoffs that have the proverbial panhandlers hat out every other minute.
The only way this will succeed, is if mojang recodes minecraft with a master-server. This would mean that if your account gets flagged for abusing these rules, they will suspend your ability from hosting a minecraft server on your account. This also means in order to run a server on any machine you need to login to your account.
So basically it will be just like minecraft client.
1. Login, to host server.
2. Check if account is flagged for violations.
3. If not violation, host server.
4. Profit.
ELSE
3. Account flagged for violations.
4. Server disabled for online play, only LAN players can join.
5. YOU LOSE, GOOD DAY SIR.
That is the only way mojang can control servers, which i doubt their team will program. So 100,000 servers will continue to operate and abuse the EULA, which means absolutely crap. I don't see how this will be beneficial to anyone.

It would be uber simple for them to deny all connections to a specific IP. you could change your ip, sure. but the whole point is to keep huge massive servers from abusing players. and i doubt you're going to have a 400+ server on your personal PC. so more than likely you're not really a concern of theirs.
If they do that then some one in the comunity will make a launcher such as multi mc and it will bypass that what you have said.
