No they won't as that would be both way outside their realm of power and absurd.
Seriously, just put up a staff application section on your server's website. (Or whatever passes as your sever website, I personally use a G+ community page for mine.) Heck if you really want to, you could just make a staff application chest into which players dropped books on which they had written their applications in game. Lots of ways to handle it outside of directly selling staff positions.

Which people? Strangers? I doubt your friends would mind if they are playing on a not so optimized server. This only brings back minecraft to its original intention of playing with friends and friends are more than willing to give you money to support the server if they want to keep playing. You can't anymore rely on the masses of strangers that wants power to keep the server going.

They don't want to donate? Then why keep the server going? You simply stop the server or use your own computer for a free and low quality server. Is it that hard to think of the solution?
How are they going to handle Bitcoin or other cryptocurrencies as a payment method? Would they consider that tender as well? If so, wouldn't ingame currencies (i.e. iConomy) be considered tender as well?

It states that there is a new donation by person via a tellraw and say command in command blocks. Hypothetically, would it be legal for, when a new donation occurs, everyone [online] gets 1 diamond?
I don't intend to do that, but it contains the idea / principle that I'm curious about. Does that fall into the category of "fair gameplay"?

I expect don't the majority of minecrafters to agree with my perspective, but yes, I believe that this is a great move. Today's minecraft servers are truly unbalanced, with too many OP kits in pvp servers, and very unfair advantages to those who pay. I am getting really upset when I join a server and see someone else taking advantage of me, because he "donated". I am allowed, and everyone is, to enjoy every minecraft feature with no limitations. For me, it will really improve the server communities, and it will actually clear the field so good servers can finally gain some popularity and value.

The change will allow us to at least have cosmetic purchases and Pay to Play as legal things. The current system allows for none of it.

As with any changes, it's all butthurt at first, and actual effort to be put in to figure out how to get comfortable with the new ways... but I say a year after it's over with, it won't be at all that bad. Won't even be felt. You just may have to pay a couple bucks to get into some bigger places... but hey, if you want to play there, you gotta support.

I maintain my server by myself! I not once asked for donations in my server! If the players decide they like the server and want to donate then they can go right ahead and donate! I even discourage donating in my server and 5 Min. ban people who tell others to donate! I DON'T WANNA LOSE MY SERVER OVER MOJANG'S EULA BS! IM AFRAID ANYTHING I DO IS ILLEGAL NOW!
I am definitely liking these EULA changes - it was always unfair to charge players money to get perks in game. In all honestly, perhaps a few "big" servers will drop off the map. However, it is by far worth it if it means equality for players playing on servers! Besides, is it really a fun and immersive gameplay experience when you worked for hours to scrape together enough diamond to make a set of armor when they guy that killed you payed $X for it? This is cool - it means that you no longer can pay real world money to gain an advantage in-game, which you shouldn't have been able to do anyways.
Here's another way of thinking about it! Remember when EA promised microtransactions in every game? They've since changed it to all their mobile games, but even so, the idea of paying for items/levels/whatever in game sucked, didn't it? Or just microtransactions in general? The whole idea of paying for your progress rather than playing for it sucks, doesn't it? Well, THAT's what Mojang is trying to prevent, and I will stand behind them every bit of the way. Congratulations to Mojang for finally stepping up and fighting for player equality, and for fighting against microtransactions.

From what I understand, every content in the server should be available to all with the exceptions of cosmetics (not counting capes). From your scenario, since everyone is receiving diamond and not only the donator, I think this is ok. This seems to reward people for being on your server since you are rewarded just by being online when someone donates on the server.
There's a 99% chance that Mojang is not going to change the EULA to allow for purchasing gameplay elements. The thing that most of you are forgetting is that: THE EULA POLICY ALREADY SAID THAT YOU COULDN'T SELL ANY PART OF THE GAME BEFORE ALL THIS DEBATE STARTED. Mojang is simply starting to enforce this policy. So for all of you complaining that this isn't fair - you should have complained when it had just been added to the EULA, not now. Now that the policy has been in place for a while, the fact that almost all server owners completely disregard it is forcing Mojang to start really enforcing it.
Now, I'm not saying that I agree with the prohibition of purchasing gameplay elements. In fact, like many posters here, I DO think that it's somewhat unfair to the servers who haven't completely adopted a "Pay-2-Win" mindset. All I'm pointing out is the fact that the EULA already stated this a while before all this debate started. They are just now enforcing it.
