Mojang needs to enforce the EULA even more than they do right now. I can't say that every 100+ player server is breaking it, but I certainly haven't seen one yet that isn't. The problem here is that games like this encourage bottom-feeders to run a server, not for the fun of the hobby, but because they want to make money. Cutting this cancer out can only improve the ecosystem.
Its gotten so bad, that any 15-year old can run a server off their own computer, using their parents internet connection, and earn money from donations, provided you have something new to offer people. Thats not an exaggeration; the last server I tried out was exactly like that.
Anyway, I'm not holding my breath over it, but I still hope Mojang will even go as far as kill off the Voting system that every server is gaming. Technically, its also a EULA violation, as its offering content differently to different people. Nothing wrecks a server more than "10 free diamonds for watching Ads and captchas on the following 10 websites!!!!1111"

This could be the end of multiplayer minecraft if this is enforced. Large servers will go down, resulting in a huge loss from mojang, cas half the people only play for multiplayer.

1) The items being sold that you seem "useful" are exactly the things that Mojamg wants to stop. For one, they already sold gameplay to users for however much they paid, and they want to prevent users from buying the gameplay again. They want equality in players. If it doesn't help speed up your specific game, doesn't give you specifically unfair gameplay advantages, then they are saying that it isn't against the EULA. The server-wide workaround is really more powerful than unfair single user advantages.

There is absolutely nothing unreasonable in the EULA, and its designed to protect the reputation of Mojang from the bottom-feeders that are clinging to their coattails. When a kid has a problem in a server, they will blame Mojang, and not know or understand that the server owner has no affiliation with Mojang.
Most servers also offer their users nothing of merit. Mojang did 95% of the heavy lifting, mod authors did another 4%, and the server owner does that last 1% to make the whole package look interesting enough to get donations. But they're not charging 1% of the labor costs... instead, donations often exceed the base price of Minecraft. That is, in a nutshell, bottom-feeding behavior, and all "server-portal" and "minigames" servers are guilty. Fortunately for them, Mojang even actively allows them to continue some of their bottom-feeding tactics... but not the one where they offer different features based on how much people donate.

Your analogy is incorrect. Minecraft to Servers is more like a Mall and having your own little shop inside of that mall. Second of all, the EULA allows you to sell access to your minecraft server (Ex: charging 20 dollars to get inside the server), so that makes your analogy even more wrong. I'll respond once you come up with a better comparison.
today it's not uncommon for these perks to include "get free diamond armor with Protection X, a diamond sword with Sharpness X and a bow with Power X and Infinity, also five diamond blocks why not.
Maybe on OP faction servers yeah, but on other servers giving out "Protection X" does not happen.

Not all servers are money hungry, some servers need the donations for running their server, and even the servers that are money hungry are still a minority of the servers.
How can a server last when people abandon it because those who didn't "donate" cannot lift a finger to those who did and have overpowered, uncraftable gear?
On the majority of P2W servers (Which is still a small amount of servers), people don't quit if there's someone with really good stuff. And in reality, PW2 servers become more successful because people want to take down the "OP" players by getting themselves a rank better or the same as the other player's.
In the end, if someone buys something on a server that costs $500 and is OP, it's still fair. Think about it: That person literally just wasted $500 on MINECRAFT, it may help them in game, but it screws them over in real life, which makes it fair.
It doesn't have to be Protection X but it's still an edge over people who didn't "donate."
If a server owner can't keep a server running without donations then they shouldn't be running a server. Donations should be an extra, not a lifeline. There were servers running before the perks got out of hand, during the time perks got out of hand and even now with Mojang cracking down there are still lots of servers to be found.
I have never heard of this happening. The scenario of joining a server brand new, walk outside of spawn, get decapitated by a more powerful player and then get told that player can only be beaten if you fork over $50 to get on their level sounds unbelievable. People are inclined to stick around if they invested lots of time in a server but to me it sounds more plausible that somebody would avoid a "donator" altogether so they don't have to serve as their punching bags.

No. The last few "large" servers I was on were a few Skyblock servers (including "the" skyblock server, though its dubious that it really was the original), and what did I see? High-ranking people able to create stacks of items with every enchantment there is in the game, at the maximum the game would support. I wandered into spawn and someone tossed me 16 pieces of redstone with Sharpness 10, Fortune 3, Flame Aspect 2.... yes, a piece of redstone, and it really did work with the Sharpness 10 on it. It was stronger than the best legitimate diamond sword, and someone tossed them out like it was trash. These were called "god items".
If people really want to play this way, then thats fine. More power to them. The problem though is that people are PAYING to play this way, and thats strictly forbidden by the EULA.

I agree, a lot of servers DO abuse donations. My brother got on a skyblock server and he could literally FLY (ruining the point of the game), he could also create any spawner he wanted, but this still doesn't change the fact that whoever donates it's THEIR choice to do so. My brother payed 50 dollars for the rank and I haven't heard him complain.
What if the "donation" applies to many people. Example: A perk that can boost your team (faster movement, more damage, etc.) Is that allowed?
Why "premium area" aren't allowed?
What if it applies to one game? Like Diamond sword for everyone who play with him (MobArena)?

If it applies to your team and not your opponents it's Pay2Win and that's one of the things that Mojang, quite rightly, want to get rid of.

Not yet . But soon they will. After their (and community) patience has over. You can report them (i don't know where is it). Please don't make another P2W server. Because there's no action it doesn't mean you should break EULA.

Of course an easy way to handle the situation is if Mojang just did what Epic games does with their engine, either require a one-time fee for a license to build and sell a server content using Minecraft as the engine, or take a percentage of the donations.
