For example, if you make REPLACEMENT images (modded graphics) that are entirely your own work, you are permitted to sell those image files to other fans for them to insert into their copy of Minecraft.jar. What you are NOT permitted to do, is put your art into your own copy of Minecraft.jar and then sell the JAR file.
Likewise on the server side of things, while you are NOT permitted to sell copies of the Minecraft server JAR file, you ARE permitted to sell the right for others to connect to the server that you are running. For example, you are permitted to run a server where others can connect, but block the IP addresses of everyone, except those who've payed, using firewall software. Then when the person pays (for example with Paypal, or whatever payment system you set up), you add their IP address to the list of allowed IP addresses in your firewall software.
And as for Minecraft artwork, it is perfectly fine to sell it. Minecraft is simply the tool with which you created the artwork. Would a company that made paint products, require you to pay not only for buying the paint but also to pay extra for the right to sell the work you made with their paint? Of course not! There's nothing illegal about selling artwork made with Minecraft.

I just want to throw my two cents into this one-sided war...again.
First off, We accepted the EULA when we bought the game, & when we subsequently updated. We can't go back on that promise now.
Second, the server owners are in no position to complain since this has been in since December of last year, and they, like the rest of us, agreed to the EULA when they started their server.
"But...but, this is our income! If our server shuts down, then I won't have any money!" That's not how it works.
Say we have this situation: A man finds his wife murdered in his house, and vows to avenge her. He manages to track down the killer & stabs him in the chest twenty times. The police find out about this & charge the man with first degree murder (or third degree, I don't know how that really works). People could argue that this goes above the law & is more of a moral issue. It's not. In the US, the Constitution is the law of the land, there is nothing that is more important that it.
It doesn't matter if the server is your source of income, and you refuse to follow it. The law states that you cannot do that, and you have to abide by Mojang's rules, or they can shut your server down. The US Constitution backs this (in the US, at least, which is probably where most servers are hosted), as you would be infringing on their right to own property by selling parts of their property on your server, such as a Diamond sword for $20.
I don't see what you're trying to argue here. I know that server stores are against the rules - but the whole point of this thread was to petition that.
As written, all servers that have stores are illegal. Therefore almost all notable servers will go down because they have a store.

But it does mean something - it's the law, and they are free to enforce it if they like. You assumed the risks of starting a server violating the TOS, be thankful that you were able to exploit it as long as you have. It is their product, and derivative works are covered in the EULA. All of it is valid under western copyright laws. Keep whining, it doesn't change reality.

Garrys Mod allows everything the current Minecraft EULA doesnt stand for, and tis probably the closest example to Minecraft of a heavily moddable server client for a video game.
You can go, code your own game for garrysmod and make money off it. Trouble in Terrorist Town from Darkland. That owner walked away with some profit under his belt and the previous Darkland owner walked off with more.
There are games, like Minecraft, moddable where you can make money and profit off it. But the EULA looks like its most likely going to be changed as Notch has even tweeted while making money selling in-game items are not allowed, you can charge a subscription fee to your server and make money, because its a subscription fee to access hardware.
However, We all know how effective subscription fees are.

This. This is exactly what they have been doing, and now they are just going to enforce it better. This EULA change is really only supposed to affect cracked accounts and launchers. They want people to actually purchase the game, not pirate it. All this worry over servers/mods doesn't really relate to this discussion.

True, you don't own Minecraft, but you run the server. Mojang does nothing server-side, therefore it is up to the owner to manage it. Why shouldn't you be able to sell items and plugin commands? "Because it's not your property" would be the expected response. But, as I said before, the server owner does a lot of work, why should he not be able to sell game features to support his server? It is not Mojang running the server, it's the owner. They shouldn't be able to dictate what happens on the server.
Also, server owners don't have to be in it just for the fun. It is actually quite stressful to run a large server because of all the aspects you have to deal with (Advertising, customer service issues, etc.) Also, not once did I refer to it as a donation. If it's an exchange, it's a taxable purchase. You should be entitled to make money off of what you manage.

Plugin and mod developers cannot put something together in their free time, for fun, then turn around and attempt to sell that to the public.
Plugin and mod developers CAN be hired out by servers, and receive pay for requested projects.
There is a line there, and as long as it is not crossed, you can continue to do what you enjoy, and still be compensated for it.

If they wanted to stop people from doing this they would have done it a log time ago; and yes it is Mojang's fault for not enforcing it.

And some people only try to make money off of servers, also this makes it more fair for other people that dont donate for example. Apart from that, depdending on your age and server size, hasn't anyone heard of a job or allowance? HELLO??? There's that, and why not update that old computer sitting in your storage for use as the server host? Jeez, I don't understand people with their blown cerebal cortexes over doing what they misunderstood! Notch is a good person, and he only means well for the community and game at large! He's not your average knuckle head here guys. He did this also because "It feels like a F2P, which I hate F2p with a passion". Notch, I hate F2Ps too, and sadly some servers try to make it that way.. Just be thankful that they aren't like Nintendo when it comes to videos. (Although it'd be lovely if the so called "Team Crafted" got removed. It'd be a miracle for everyone else, and they're only in it for the the mad amounts of money... but enough of my blabbering.)
Look, the point is if Notch says something like this, it's only for the good for everyone. If he notices something, he'll reverse it. Besides, if one is to donate, it should not ONLY be just for the buffs, it should also be because that server is awesome.

I know it's not fair to Mojang, but people wouldn't be so dependent on this nowadays if they got off their butts and enforced this from the beginning.
Garrys Mod allows everything the current Minecraft EULA doesnt stand for, and tis probably the closest example to Minecraft of a heavily moddable server client for a video game.
You can go, code your own game for garrysmod and make money off it. Trouble in Terrorist Town from Darkland. That owner walked away with some profit under his belt and the previous Darkland owner walked off with more.
There are games, like Minecraft, moddable where you can make money and profit off it. But the EULA looks like its most likely going to be changed as Notch has even tweeted while making money selling in-game items are not allowed, you can charge a subscription fee to your server and make money, because its a subscription fee to access hardware.
However, We all know how effective subscription fees are.

- True, you can have a job/allowance - but they don't have to be your only income. Why not allow people to also make profit off of Minecraft servers (that are compliant with customer issues such as stolen credit cards etc.)?
- It costs money either way, proper hosting is just more money-effective. I don't see what you're trying to argue.
- You say you hate F2Ps, which are free to plays. I'm going to assume you meant pay to play, otherwise you'd just be contradicting yourself. If you don't like pay to play servers, just don't play. It is a personal choice that the server owner makes. If he puts in the time to research what the community wants, what the possibilities are, what is the most cost-effective hosting, how will he deal with players, build the structures, download the plugins, advertise, and put endless hours of work into the server, he should be able to make profit/income off of it by selling some of these features (items and plugin commands). I believe Garry's Mod handles this properly, a lot like Minecraft used to. Allow people to buy the client from them (Minecraft/Garry's Mod) and let the developers and owners make their own profit by manipulating the game into something people like.

Like I said, donations won't go away, just blatant penny-pinching. But let's say this change actually did ban all form of donations.
Many servers actually pay out of pocket with these magical new things that nobody seems to believe exist.

If you have a job that pays a decent amount, you can put down money on hardware of your own to host a server, or rent an inexpensive server(although buying and maintaining the hardware yourself is far wiser)

BuyCraft gets shafted because you're literally being made to buy parts of the game.
Mineplex is fine because you're buying improved service/features, and not actual parts of the game.
MCPH is server hosting. You can buy server space without violating the EULA.

If you want to make money, do it in a less cheap, shady way
Find some other way to separate bratty kids and irresponsible parents from their money.
If you host a server, you do it because you want to have fun and create fun for others. Not because you want to get paid.
If you ask for donations, you do it in a not-for-profit manner.
You don't sell the game piece by piece to the player to squeeze extra pennies out of the userbase.
You don't act like you're entitled to make money off of a game someone else made just because they were nice enough not to swat you for all these years.
People are finally getting called out on their actions and they don't even have the decency to admit that what they're doing is cheap and illegal, and pack up and do something else.
This. This is exactly what they have been doing, and now they are just going to enforce it better. This EULA change is really only supposed to affect cracked accounts and launchers. They want people to actually purchase the game, not pirate it. All this worry over servers/mods doesn't really relate to this discussion.

True, you don't own Minecraft, but you run the server. Mojang does nothing server-side, therefore it is up to the owner to manage it. Why shouldn't you be able to sell items and plugin commands? "Because it's not your property" would be the expected response. But, as I said before, the server owner does a lot of work, why should he not be able to sell game features to support his server? It is not Mojang running the server, it's the owner. They shouldn't be able to dictate what happens on the server.
Also, server owners don't have to be in it just for the fun. It is actually quite stressful to run a large server because of all the aspects you have to deal with (Advertising, customer service issues, etc.) Also, not once did I refer to it as a donation. If it's an exchange, it's a taxable purchase. You should be entitled to make money off of what you manage.

If you're not willing to invest money into the server and if people are not willing to donate because they enjoy the server then that's really on you.
However, nothing is set in stone and depending on what kind of "perks" you offer you might not even be that affected in the future.
