Everyone here (mostly) is saying that this action of taking a build off of someone else's server is legal.
This assumption is not valid, and copying their build is probably illegal. I'm no lawyer, but I do know that once a work is created, it is protected by US copyright laws. I looked it up online just now and I've confirmed this.
Assuming whoever built the spawn is a US citizen (which may or may not be a good assumption), they have complete control over their works. And you copied it, you are breaking copyright laws.
Ahhh, but
Don‘t forget that we still own the Website and the content on it, but we are giving you a permission to use it. We want you to enjoy using our Website, but if we want, we can take away your permission to use our Website at any time for any reason.
Minecraft TOS. Mojang owns all content on the website and Minecraft.
I'd like to add in the additional information he never told you:
1. He tried to pass our spawn(what he stole) off as something he built. Unless it was copyrighted, sorry, you're out of luck.
2. He did not give credit to our staff who built it. In his post, he clearly stated that he did.
3. When asked to remove it, he said he would. We returned a few days later, he said he changed his mind. That you should confront him about, I guess, but still, you can't do anything about it.
His server also accepts payments from players they've been attracting with the spawn. Unless the spawn strongly encourages players to donate, again, nothing you can do.
Sorry, but BTW, I've been on BeastsMC, and the spawn looks awesome. Just saying
Rollback Post to RevisionRollBack
The pen is mightier than the sword. I keep the sword for the day I run out of ink.
His server also accepts payments from players they've been attracting with the spawn.
Oh no, he did something on a video game and is making moneys! Call the internet police!
Besides, who cares if he is making money? Not like only one person is supposed to get all the money in the world!
its not illegal they don't own a patent on the creation. I think by "learn you lesson" they mean grief or DDoS your server. but yeah remove it, its better to be original rather than take there servers creations
As long as its not copyrighted its no illegal. However its considered "bad" to copy other peoples work without giving them credit so if I were you I would either remove it or give the guy credit for building it.
"Copyright, a form of intellectual property law, protects original works of authorship including literary, dramatic, musical, and artistic works, such as poetry, novels, movies, songs, computer software, and architecture."
"Your work is under copyright protection the moment it is created and fixed in a tangible form that it is perceptible either directly or with the aid of a machine or device. "
"In general, registration is voluntary. Copyright exists from the moment the work is created."
1. Considering this is just a sandbox game, copying someone else's own and calling it yours isn't illegal. Creations made in games do not lay within the confides of copyright law.
Beasts, as you've posted above, I think that article is referring to literal architecture. Not anything related to a game. Like one of the examples listed...
...novels, movies, songs...
if you try to compare the two here, that's like trying to copyright a song created within a song. It doesn't really work that way.
2. As I said I don't think it's illegal, but it is frowned upon. It's someone else's work they've invested time and dedication into. It's definitely frowned upon.
EDIT: Also, if I'm not mistaken, you must register a copyright...
To register a work, submit a completed application form, a nonrefundable filing fee, which is $35 if you register online; and a nonreturnable copy or copies of the work to be registered...
EDITEDIT: If you really think that your build has been stolen from you, something you have copyrighted. Then you are more than happy to file a civil lawsuit.
Quote:
A party may seek to protect his or her copyrights against unauthorized use by filing a civil lawsuit in federal district court. If you believe that your copyright has been infringed, consult an attorney. In cases of willful infringement for profit, the U.S. Attorney may initiate a criminal investigation.
In my opinion:
1) It's disrespectful for a server owner to copy someone's spawn without permission, and even more so to do when they specifically ask you not to use their content.
2) It would be immature to make another server "learn their lesson", and it would also make your server look bad.

false! if what this is true, every 3 year old's scribble would be copywrited.
Wrong. You will have to apply and register yor work for it to become copyrighted. Otherwise the work wont be copyrighted. If you register your creation and fix a copyright for it, you can sue anyone who usues it but until then theres not much to do. This happends ALL the time.
true! if you want something patented/copywrited, you have to apply for it. and when you receive the patent, it applys retroactively to its creation date. that's why there're so many court battles, because two people receive similar patents, and they have to prove which one was created first.

strenbeath, don't misquote me. I didn't say that, BeastMineCraft did (I do agree with it though)
and I'm going to clarify my point: I know that if a work is created, that work is his and he is the only one who can claim copyright. Meaning, he can choose to prevent anyone else from copying his works.
In other words it is up to the creator to ensure that his rights are preserved.
What's happened here, is that one person has copied a build from one server and claimed it as their own. The copier probably thought it was okay, since people who play Minecraft generally don't care about if a few meaningless blocks are copied. However, the creators are not okay with this action and are demanding that the copier gets rid of what they did illegally copy. The creators are very correct: that is their work, and since they do mind people copying it, they are taking action to prevent it from being copied.
So hutt132 better do as they ask before he gets sued, his server shut down, his village invaded by flesh eating zombies, or a combination of the previous.
Can you even copyright something that you've made using someone else's assets? Minecraft and it's content belongs to mojang, not the player. Mojang made(and own) the blocks and the code behind them, you just arranged them in a different way.
Trying to copyright that sounds like taking someone else's car, changing the paint color and rims, then trying to say it's yours.

You don't seem to understand how the copyright system works. There is nothing either server owner can do if anyone logs into there server, and copys a building or idea they found there. None of there work is copyrighted, because they are unable to have it copyrighted in a video game for which they do not own the liscense to. They can both rage and scream all they want but neither has any claim to the object in question.
If the objects in question where real world items, and the designer went through the correct steps to have it copyrighted. Then and only then could they file leagle course and have it dealt with. But as this is all inside of a video game which none of us here own the leagle rights to. We only own the rights to use the software as deemed by the company that copyrighted it.

I believe you misunderstand my point, and I feel like you stating that I don't know anything about the copyright system is unwarranted. http://www.copyright.gov/circs/circ01.pdf
The following link is where I am getting my information. It clearly says on page 1 that authors of original works have the rights to copy their work and have it publicly displayed. It also states that it is illegal for someone else to violate the authors copy rights. Further down on page 3 it states:
The way in which copyright protection is secured is frequently misunderstood. No publication or registration or other action in the Copyright Office is required to secure copyright.Copyright is secured automatically when the work is created, and a work is “created” when it is fixed in a copy or phonorecord for the first time.
So people do actually have claims to copyrights on Minecraft creations. The question is, will any one actually sue another person for copying their work?
What I want people to know, is that just because someone didn't formally copyright something, doesn't mean it isn't protected.
I am not a lawyer, but I have provided evidence for what I know to be true. If you wish to point out something I have missed, please provide evidence that anyone can look up.

Here's the piece you're missing: Original work.
What you make in Minecraft isn't an original work.
Minecraft itself is the original work(whose copyright belongs to Mojang) and you're just changing parts of it.

Our spawn is copyrighted. It is an original creation by my admins.

You can't get into legal trouble unless the build has been copyrighted.
