"you're sure somewhere in the tos, blah blah blah..." ...No. If you actually read the TOS and understand the legal terms used, what it says is that Minecraft and all of its assets are property of Mojang, but mods that you create for the game are derivative works and you legally own everything that you created, but not anything of Mojang's that you re-use, modify or repurpose.
Relating this specifically to Optifine: Mojang does not own Optifine. Mojang does not own any Optifine code. Mojang does not own any assets that Optifine creates. Mojang DOES continue to own any Mojang assets which Optifine reuses.

Considering that Magic Launcher and Optifine do not hinder your ability to login in any way, I don't see what problem you're having. If by that, you mean the game keeps crashing when you try, then you might just stop using the Magic Launcher, and go back to the official launcher. If this still doesn't work, then try deleting the "versions" folder in your .minecraft directory, and try again.
If you do actually mean that you can't login with your username and password, then you may have forgotten one of them, or you may be trying to login with your username rather than your email. In the username spot, try typing in your email address instead, and then your regular password. (this is how most people sign in anymore)
In any case, Optifine shouldn't cause issue if everything was installed correctly. If you wish for further instructions, or still need help trying to fix your game, then be sure to quote my post with details as to what you did, and what happens when you try to login/enter the game.

He did not explicitly say to stop using Forge with Optifine. A choice was implied. The options are the following:
1. Don't use Forge if you insist on installing Optifine into the minecraft.jar.
2. If you are using Forge, then install Optifine the way you install most other Forge mods, which is by simply placing the Optifine .jar into the "mods" folder.
Optifine is now designed to work nicely alongside Forge by adding the ability to install it right into the mods folder without ever having to edit the minecraft.jar, or the 1.6.4.jar or whatever.
